May 25, 2021 <br /> <br /> WHEREAS, <br />pursuant to the Housing and Community Development Act of 1974, <br />as amended, and the Cranston-Gonzalez National Affordable Housing Act of 1992, as <br />amended, (“Acts”), financial assistance is provided to enable localities to provide decent <br />housing, establish and maintain suitable living environments, and expand economic <br />opportunities for low to moderate income residents; and <br /> <br />WHEREAS, <br /> each of the Community Planning and Development programs <br />(Community Development Block Grant and Home Investment Partnerships) shall be <br />operated on a single consolidated program year; and <br /> <br />WHEREAS, <br /> the required public hearing has been held and the City Council has <br />reviewed the proposed 2022 Annual Action Plan; and <br /> <br />WHEREAS, <br />it is necessary that this Council take official action regarding the 2022 <br />Annual Action Plan to comply with the regulations of the aforementioned Acts; and <br /> <br />WHEREAS, <br />this Council is aware of the federal regulations governing the <br />undertaking and carrying out of activities under the community planning and development <br />programs; and <br /> <br />WHEREAS, <br />this Council recognizes its responsibility to direct that safeguards be <br />established to protect employees from using their positions for a purpose that gives the <br />appearance of being motivated by a desire for private gain for themselves or others, <br />particularly those with whom they have family, business or other ties; and <br /> <br />WHEREAS, <br />this Council has found that the proposed 2022 Annual Action Plan is <br />appropriate to meet the needs of the City and, therefore, is acceptable. <br /> <br />NOW THEREFORE BE IT RESOLVED <br />by the Council of the City of Portsmouth, <br />Virginia, that the proposed 2022 Annual Action Plan having been reviewed and <br />considered, said Plan be and hereby is approved as final in all respects, and the City <br />Manager is hereby authorized to file any additional information as may be required with <br />the Department of Housing and Urban Development in order to obtain funding for the <br />programs addressed in the Plan. <br /> <br />BE IT FURTHER RESOLVED <br /> that the City Manager is designated as the certifying <br />officer and authorized representative of the City of Portsmouth and shall provide <br />assurances as required of the locality by the Acts for the approval of the Program.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />21 – 158 - Adoption of a resolution to request a waiver from the State Board of <br />Elections to allow for the continued administration of existing split precincts for <br />any election held in 2021. <br /> <br /> <br />Background: <br /> <br /> Section 24.2-307 of the Code of Virginia mandates that “\[e\]ach precinct shall be <br />wholly contained within a single congressional district, Senate district \[and\] House of <br /> <br />Delegates district…”. <br /> <br /> Precincts that are not wholly contained within such districts are referred to as “split <br /> <br />precincts”. <br /> <br /> In accordance with Section 24.2-307, Virginia has mandated that all split districts <br /> <br />must be eliminated by no later than June 15, 2021. <br /> <br /> Portsmouth has two split precincts: Precinct 35 (Churchland Elementary School), <br />which contains voters represented by both House of Delegates District 79 and House of <br />Delegates District 80; and Precinct 38 (Grove Baptist Church), which contains voters <br /> <br />represented by both State Senate District 2 and State Senate District 18. <br /> <br /> <br />Discussion: <br /> <br /> The precinct boundary lines in Portsmouth must ultimately be revised to eliminate <br />split precincts. <br /> <br /> <br /> <br /> <br />
