April 27, 2021 <br /> <br />- Unfinished Business - <br /> <br />21 - 113 - Use permit application: <br /> <br />(a) UP-21-01 MOUNT HERMON - Robert C. Barclay, IV, Esquire of Cooper, <br />Spong and Davis, PC, on behalf of the Mount Hermon Community <br />Improvement Foundation, requests a Use Permit at 3001 High Street <br />for an entertainment establishment. The property is zoned General <br />Mixed Use, GMU. The Build One Portsmouth Comprehensive Plan <br />recommends commercial development. Planning Commission <br />recommends approval with conditions. Deferred from the April 13, <br />2021 City Council Meeting. <br /> <br />1. Robert Barclay, 200 High Street, requested a deferral allowing the applicant time to <br />meet with the civic league. <br /> <br />Motion by Dr. Whitaker, and seconded by Mr. Barnes, to deny Item UP-21-01, and <br />was adopted by the following vote: <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br /> <br /> There was a consensus of City Council to not bring this item back for a second <br />reading. <br /> <br /> Councilwoman Lucas-Burke asked for clarity as to why applicants have to come back <br /> <br />for a second reading if there is a super majority or unanimous vote by City Council. <br /> <br /> <br /> Interim City Attorney Stromberg informed City Council that the second reading of use <br />permits and zoning changes are part of the City Code. <br /> <br /> <br /> There was a consensus of City Council to have staff come back with the process to <br /> <br />rescind the Section of City Code that requires second readings for use permits and <br />zoning changes. <br /> <br />21 - 113 - Use permits: <br /> <br /> Motion by Dr. Whitaker, and seconded by Mr. Woodard, to adopt the following <br />resolution approved on first reading at the April 13, 2021 meeting, and was adopted by <br />the following vote: <br /> <br />21-113b: <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-21-02) TO KENJOH OUTDOOR, LLC <br />TO CONSTRUCT A PERMANENT FREESTANDING OUTDOOR ADVERTISING SIGN <br />STANDING APPROXIMATELY 50 FEET HIGH, AND HAVING A SIGN AREA WITH <br />APPROXIMATE DIMENSIONS OF 14 FEET BY 48 FEET, AT 1420 COLUMBUS <br />AVENUE (TAX PARCEL 0208-0021). <br /> <br /> <br />WHEREAS <br /> , Kenjoh Outdoor, LLC, the contract lessee of the subject property, has <br />made application pursuant to Section 40.2-533 of the Code of the City of Portsmouth, <br />Virginia for the granting of a use permit to construct a permanent freestanding outdoor <br />advertising sign standing approximately 50 feet high, and having a sign area with <br />approximate dimensions of 14 feet by 48 feet, at 1420 Columbus Avenue (Tax Parcel <br />0208-0021); and <br /> <br />WHEREAS, <br /> Columbus Ave., LLC, the owner of the subject property, has <br />consented to the application; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br /> <br /> <br /> <br /> <br />
