December 8, 2020 <br /> <br />Background: <br /> <br /> Article Three of Chapter 36 of the Code of the City of Portsmouth, Virginia contains <br /> <br />requirements for the landscaping of developments. <br /> <br /> <br /> Landscaping requirements are in the nature of zoning and site plan regulations. <br /> <br /> The requirements for the landscaping of developments have been incorporated <br />into the Amended and Restated Zoning Ordinance that is proposed to be adopted at the <br /> <br />December 8, 2020 City Council meeting. <br /> <br /> Therefore the existing requirements in Article Three of Chapter 36 should be <br /> <br />deleted. <br /> <br />Discussion: <br /> <br /> Moving landscaping requirements to their logical location in the Zoning Ordinance <br />will make it easier for both staff and the general public to find and determine the applicable <br /> <br />regulations for development. <br /> <br />Financial Impact: <br /> <br /> N/A <br /> <br />Staff Recommends: <br /> <br /> Adoption of the ordinance. <br /> <br />Next Steps Following Council Action: <br /> <br /> The Amendment will be forwarded to Municode for incorporation into the published <br /> <br />City Code. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Clark, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE TO AMEND AND REORDAIN CHAPTER 36 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA (VEGETATION) BY DELETING ARTICLE THREE <br />THEREOF (TREE PLANTING AND REPLACEMENT) FOR THE PURPOSE OF <br />ELIMINATING THE DUPLICATION OF PROVISIONS CONTAINED IN THE AMENDED <br />AND RESTATED ZONING ORDINANCE.” <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />20 - 318 - Adoption of a resolution authorizing the conveyance of 0 Harbor Center <br />Court (commonly known as the North Pier) by the Economic Development <br />Authority to Waterfront Acquisition, LLC, a subsidiary of Fairlead Integrated, and <br />further authorizing the execution of a Cooperation Agreement with EDA addressing <br />development of the property. <br /> <br />Background: <br /> <br /> The City conveyed the North Pier property to EDA in 2001. <br /> <br /> The Deed included a restriction requiring EDA to obtain City approval prior to <br />conveying the North Pier for development. <br /> <br /> EDA has entered into an Agreement with Waterfront Acquisition, LLC (a subsidiary <br />of Fairlead Integrated) to develop the North Pier with a facility for the fabrication, <br />preservation, outfitting and storage of Navy vessels. <br /> <br /> On November 24, 2020 City Council approved the first reading of a rezoning <br />application to allow the proposed use. On December 8, the application will be presented <br />for a second reading and final approval. <br /> <br /> EDA’s Agreement with Waterfront Acquisition, LLC provides for the recordation of <br />restrictions to protect adjacent non-industrial uses, including Atlantic Union Bank Pavilion, <br />from any adverse impacts resulting from the North Pier development. <br /> <br /> In addition, EDA has agreed to set aside one half ($250,000) of the purchase price <br />from the North Pier conveyance for a period of four years so that the City can make any <br />improvements to the Pavilion property that the City deems necessary or desirable to <br />protect the venue from adverse impacts. <br /> <br /> <br /> <br /> <br /> <br />
