December 8, 2020 Motion by Ms. Lucas-Burke, and seconded by Mr. Battle, to adopt the following ordinance, and was adopted by the following vote: “ORDINANCE ACCEPTING COVID-19 MUNICIPAL UTILITY RELIEF PROGRAM FUNDING IN THE AMOUNT OF NOT TO EXCEED $3,020,999 FROM THE VIRGINIA STATE CORPORATION COMMISSION AND APPROPRIATING SAID AMOUNT TO THE FY 2021 GRANTS FUND FOR USE BY THE DEPARTMENT OF PUBLIC UTILITIES TO PROVIDE ASSISTANCE TO CUSTOMERS WHO ARE IN ARREARS ON THEIR WATER BILLS DUE TO THE IMPACTS OF COVID-19.” Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe Nays: None 20 - 316 - Adoption of an ordinance to amend and reordain Appendix A of the Code of the City of Portsmouth, Virginia for the purpose of conforming citations for planning and zoning fees to the Amended and Restated Zoning Ordinance. Background:  Appendix A of the City Code sets forth current fees established by City Council for various applications and permits.  The citation for the planning and zoning fees in the current Appendix A is to Chapter 40.1, the current Zoning Ordinance.  An Amended and Restated Zoning Ordinance is proposed to be adopted at the December 8, 2020 City Council meeting.  The Amended and Restated Zoning Ordinance will constitute a new Chapter 40.2 of the City Code, and Chapter 40.1 will be repealed.  Therefore it is necessary to change the citation for planning and zoning fees in Appendix A from Chapter 40.1 to Chapter 40.2, and to make certain other modifications to conform to the terminology used in the Amended and Restated Zoning Ordinance. Discussion:  The proposed ordinance simply changes the citation in Appendix A and makes certain terminology modifications. It does not modify any of the actual fees. Financial Impact:  N/A Staff Recommends:  Adoption of the ordinance. Next Steps Following Council Action:  The Amendment will be forwarded to Municode for incorporation into the published City Code. Motion by Ms. Psimas, and seconded by Mr. Battle, to adopt the following ordinance, and was adopted by the following vote: “ORDINANCE TO AMEND AND REORDAIN APPENDIX A OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA FOR THE PURPOSE OF CONFORMING CITATIONS FOR PLANNING AND ZONING FEES TO THE AMENDED AND RESTATED ZONING ORDINANCE.” Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe Nays: None 20 - 317 - Adoption of an ordinance to amend and reordain Chapter 36 of the Code of the City of Portsmouth, Virginia (Vegetation) by deleting Article Three thereof (Tree Planting and Replacement) for the purpose of eliminating the duplication of provisions contained in the Amended and Restated Zoning Ordinance.
