September 22, 2020 <br /> <br />Next Steps Following Council Action: <br /> <br /> The existing easement will be vacated and a new easement granted. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Clark, to adopt the following resolution, <br />and was adopted by the following vote: <br /> <br />“RESOLUTION AUTHORIZING THE RELOCATION OF A WATER LINE EASEMENT <br />IN FAVOR OF THE CITY LOCATED ON PROPERTY IN CHESAPEAKE OWNED BY <br />CHURCHLAND VENTURES, LLC. <br /> <br />WHEREAS, <br /> by Deed of Easement dated April 27, 2020 Churchland Ventures, LLC <br />granted the City a Deed of Easement over a portion of certain property located in <br />Chesapeake and having a Tax Parcel Number of 0041003000001 (the “Original <br />Easement”); and <br /> <br />WHEREAS, <br /> the Original Easement is recorded in the Chesapeake Circuit Court <br />Clerk’s Office in Deed Book 10149 at Page 1891; and <br /> <br />WHEREAS, <br /> the Original Easement was for the construction and maintenance of a <br />water line to be owned by the City of Portsmouth; and <br /> <br />WHEREAS, <br /> the water line was subsequently constructed, but as constructed the <br />line is not located in the center of the easement area granted by the Original Easement; <br /> <br />WHEREAS, <br /> to protect the City’s water line it is necessary to vacate the Original <br />Easement and accept a new easement centered on the water line as constructed; <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> (1) That it authorizes the vacation and release of the Original Easement; <br /> <br /> (2) That the City hereby accepts a replacement easement centered on the <br />water line as constructed; <br /> <br /> (3) That the City Manager is authorized to execute such easements, <br />agreements or other instruments as are necessary to vacate and release the Original <br />Easement and accept the replacement easement; and <br /> <br /> <br /> (4) That this resolution shall take effect immediately upon its adoption.” <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />- New Business - <br /> <br />20 - 228 - Items Submitted by Council Members <br /> <br />• Adoption of a resolution authorizing and directing the City of Portsmouth to <br />engage in collective bargaining with employees. <br /> <br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, asked that City Council defer this item to <br />thoroughly examine the fiscal strength of the City if implemented. <br /> <br />Motion by Mr. Clark, and seconded by Mr. Battle, to adopt the following resolution, <br />and was adopted by the following vote: <br /> <br />“RESOLUTION AUTHORIZING AND DIRECTING THE CITY OF PORTSMOUTH TO <br />ENGAGE IN COLLECTIVE BARGAINING WITH EMPLOYEES. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
