July 16, 2020 <br /> <br />IT BEING the same property conveyed to Victory West Thrill Park, LLC by Deed from <br />Zway II, L.L.C. dated May 3, 2017 and recorded in the Portsmouth Circuit Court Clerk’s <br />Office as Instrument Number 170004603. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The outdoor kennel use is only permitted in the area of the property shown on the <br />approved site layout plan and shall be located as indicated on the approved site layout <br />plan. <br /> <br />(b) No more than 14 (7 per outdoor play area) dogs shall be present in the outdoor <br />kennel area at any one time. <br /> <br />(c) The kennel area, including fencing, shall be maintained in a safe and sanitary <br />condition. <br /> <br />(d) All animal waste from the outdoor dog kennel shall be collected and disposed of in <br />a lawful manner on a daily basis. <br /> <br />(e) The applicant shall obtain all required local, state, and federal licenses and permits <br />prior to commencing operation, and the licenses and permits shall be kept current at all <br />times during operation of the use. <br /> <br />(f) All taxes and fees associated with the use shall be paid when due. <br /> <br />(g) Noise from the outdoor kennel area shall comply with City Code Section 24-255 <br />(Loud Disturbances and Unnecessary Noise or Sound). <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br />20 - 170 - Adoption of an ordinance accepting CARES Act funding in the amount of <br />$8,235,862 and appropriating said amount in the FY 2021 Grants Fund for use by <br />the City in accordance with the Act. <br /> <br />Background: <br /> <br /> <br /> The CoronavirusAid, Relief, and Economic Security (CARES) Act of 2020 <br />provides funding for a number of different programs to address the COVID-19 pandemic. <br />A primary component of the CARES Act is $150 billion in assistance to state, local, <br />territorial, and tribal governments for the direct impact of the COVID-19 pandemic through <br />the establishment of the Coronavirus Relief Fund (CRF). <br /> <br />Discussion: <br /> <br /> While the federal CARES Act does not require that states distribute funding to local <br />governments with populations less than 500,000 residents, Governor Ralph Northam <br />recognizes that localities are experiencing the same COVID-19 related expenses as the <br />Commonwealth. Therefore, fifty (50) percent of the locally-based allocations will be <br />distributed to counties and cities by the Department of Accounts (DOA) after receipt of a <br />signed certification from the locality. This distribution will be made to the local treasurer <br />in the same manner that Car Tax Relief Payments are made. <br /> <br /> The city was awarded $8,235,862 of “one-time” monies to assist with necessary <br />expenditures incurred due to the public health emergency for COVID-19. <br /> <br /> $1,000,000 of the CARES Act funding is anticipated to be used for the COVID-19 <br />Business Recovery Grant Program, administered through the Economic Development <br />Department. <br /> <br /> <br /> <br /> <br /> <br />
