July 16, 2020 <br /> <br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, commented his concern on the inability <br />for citizens to fully participate in the meetings. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Ms. Psimas, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE CONFIRMING AND CONTINUING ORDINANCE 2020-21 ADOPTED <br />ON APRIL 14, 2020 AND THE EMERGENCY PROCEDURES ESTABLISHED <br />THEREUNDER TO ENSURE THE CONTINUITY OF LOCAL GOVERNMENT DURING <br />THE COVID-19 PANDEMIC.” <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />b. Adoption of a resolution requesting and petitioning that a referendum be <br />held on the question of whether casino gaming shall be permitted within the City <br />of Portsmouth. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION REQUESTING AND PETITIONING THAT A REFERENDUM BE HELD <br />ON THE QUESTION OF WHETHER CASINO GAMING SHALL BE PERMITTED <br />WITHIN THE CITY OF PORTSMOUTH. <br /> <br />WHEREAS, <br /> by Ordinance 2020-47 adopted on May 26, 2020 City Council <br />selected Rush Street Gaming LLC and Portsmouth Gaming Holdings, LLC (collectively, <br />“Developer”) as the City’s “preferred casino gaming operator” within the meaning of <br />Sections 58.1-4100 and 58.1-4107 of the Virginia Code; and <br /> <br />WHEREAS, <br /> the City promptly submitted the Developer as its preferred casino <br />gaming operator to the Virginia Lottery Department (“Lottery”); and <br /> <br />WHEREAS, <br /> Lottery has successfully completed its preliminary review of the <br />Developer and, in accordance with Subsection 58.1-4107(F) of the Virginia Code, has <br />certified its approval for the City of Portsmouth to proceed to the casino gaming <br />referendum required by Virginia Code Section 58.1-4123; and <br /> <br />WHEREAS, <br /> Subsection 58.1-4123(B) of the Virginia Code provides that “\[t\]he <br />governing body…\[of an\] eligible host city shall petition the court, by resolution, asking that <br />a referendum be held on the question of whether casino gaming shall be permitted within <br />the city”; <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that it hereby petitions the Circuit Court for the City of Portsmouth, Virginia to <br />request that a referendum be held on the question of whether casino gaming shall be <br />permitted within the city of Portsmouth; and <br /> <br />BE IT FURTHER RESOLVED <br /> that it requests that the said referendum be held on <br />November 3, 2020, in accordance with Section 6 of Acts of Assembly Chapter 1197, <br />approved on April 4, 2020; and <br /> <br />BE IT FURTHER RESOLVED <br /> that the City Attorney and his designees are <br />authorized and directed to file the appropriate Petition and pleadings with the Portsmouth <br />Circuit Court in furtherance of the purpose of this Resolution; and <br /> <br />BE IT FURTHER RESOLVED <br /> that the City Manager, City Attorney, and their <br />designees are authorized to take such further actions as are necessary or desirable in <br />furtherance of the purpose of this Resolution; and <br /> <br />BE IT FURTHER RESOLVED <br /> that this Resolution shall take effect on the date of <br /> <br />adoption.” <br /> <br /> <br /> <br /> <br />
