<br />Background:
<br />
<br /> On March 23, 2020, the City Manager presented the proposed Fiscal Year 2021
<br />Operating Budget and Capital Improvement Program (CIP) to City Council to include
<br />Portsmouth Public Schools.
<br />
<br /> The proposed Capital Improvement Program (CIP) is for Fiscal Years 2021-2025
<br />and appropriating funding for Year One for the necessary funds in the Capital
<br />Improvement Fund and the Parking Authority Capital Improvement Fund.
<br />
<br /> The budget was discussed during March and April with each member of City
<br />Council and virtual public hearings were held on April 28 and May 12, 2020. The attached
<br />ordinances are required for adoption of the Fiscal Year 2021 Operating Budget and the
<br />Capital Improvement Budget.
<br />
<br /> On April 28, 2020, a Public hearing was held on the Community Development
<br />Block Grant (CDBG) & Home Investment Partnerships Program (HOME). The Fiscal Year
<br />2021 CDBG and HOME Program funding from the Department of Housing and Urban
<br />Development (HUD) includes CDBG entitlement funding of $1,614,295 and program
<br />income of $44,880 (total $1,659,175); and HOME entitlement funding of $429,589.

<br />Discussion:
<br />
<br /> By Virginia law, the budget must be in balance, with estimated revenues and other
<br />funding sources equaling appropriations. The Proposed Operating Budget and Capital
<br />Improvement Budget for Fiscal Year 2021 complies with this law.
<br />
<br />City Operating Budget
<br />
<br /> The Ordinances necessary to adopt the Fiscal Year 2021 Operating Budget are
<br />attached to this report for City Council action as follows:
<br />a) Adoption of an ordinance to amend and re-enact ordinance No. 2019-25 to impose
<br />and levy taxes for the Fiscal Year 2021, on real estate, tangible personal property,
<br />privately-owned pleasure boats, privately-owned camping trailers and motor homes, and
<br />machinery and tools within the City of Portsmouth, Virginia, for the purpose of raising
<br />revenue for the support of governmental operations and the public free schools and to
<br />pay principal and interest on the public debt. The ordinance re-ordains the current tax on
<br />real estate and public service corporations at $1.30 on each $100.00 assessed valuation.
<br />b) Adoption of an ordinance to amend and re-ordain Article IX (Restaurant Food Tax)
<br />of Chapter 35 of the Code of the City of Portsmouth, Virginia (2006) as amended
<br />(Taxation), by amending Section 35-407 to increase the Restaurant Food Tax to 7.5%.
<br />c) Adoption of an ordinance to amend and reordain Sections 32-60, 32-61,9.1-11,
<br />11-5,11-6,38-56,38-40,38-42 and Appendix A, and to establish new sections 25-91.3 and
<br />38-9 of the Code of the City of Portsmouth, Virginia (2006) for the purpose of increasing
<br />or establishing rates and fees for right–of-way disturbance, Chesapeake Bay
<br />Preservation Review, temporary street closures, site plan review, land disturbance
<br />permits, boat ramp parking, water meters and related water and sewer services, boating
<br />permits and metered parking.
<br />d) Adoption of an ordinance to amend Appendix A of the Code of the City of
<br />Portsmouth, Virginia (2006) to increase monthly stormwater utility fees as authorized by
<br />Section 31.2-26 of said Code.
<br />e) Adoption of an ordinance to amend Appendix A of the Code of the City of
<br />Portsmouth, Virginia (2006) to increase rates for water and sewage services as
<br />authorized by sections 38-83 and 38-117 of said Code.
<br />f) Adoption of an ordinance approving the Fiscal Year 2021-2025 Capital
<br />Improvement Program and appropriating $24,987,313 in the Fiscal Year 2021 Capital
<br />Improvement Fund and $100,000 in the Fiscal Year 2021 Parking Authority Capital
<br />Improvement Fund.
<br />g) Adoption of an ordinance approving the Fiscal Year 2021 Operating Budget for the
<br />Portsmouth Public School System in the amount of $210,890,572 and appropriating the
<br />necessary funds to implement said budget for the Fiscal Year 2021.
<br />h) Adoption of a resolution approving the Community Planning and Development
<br />2021Annual Action Plan of the City of Portsmouth, Virginia, and authorizing the City
<br />Manager to file documents required to obtain the City’s Community Planning and
<br />Development grant entitlements.
