January 14, 2020 <br /> <br /> ALL THAT certain lot, piece or parcel of land shown on that certain plat titled “Boundary <br />Survey of Property of City of Portsmouth/Containing 30.9297 Acres/As Described in D.B. <br />1038 PG. 46, D.B. 1016 PG. 24 & D.B. 500 PG. 123/Portsmouth, Virginia”, dated <br />February 9, 2007, prepared by Woolpert, Inc., and recorded in the Clerk’s Office of the <br />Circuit Court for the City of Portsmouth, Virginia in Map Book 21 at Page 102. <br /> <br />IT BEING all that certain property conveyed to the Economic Development Authority of <br />the City of Portsmouth, Virginia by Deed from the City of Portsmouth, Virginia dated March <br />16, 2007 and recorded in the Clerk’s Office of the Portsmouth Circuit Court as Instrument <br />Number 070006292. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The proposed development shall be in substantial compliance with the <br />concept plan titled Conceptual Layout for 409 McLean Street: A Multi-Family Residential <br />Development, prepared by AES Consulting Engineers and dated September 20, 2019, <br />and the rendered concept elevations titled Composer Model and Hepburn Model <br />prepared by Ryan Homes and on file with the Planning Department, except where <br />modifications may be required to comply with all applicable local, state, and federal codes <br />and regulations. <br /> <br />(b) If a neighborhood boundary fence is constructed along the McLean Street <br />frontage, the style, materials, dimensions and other aspects of the fence shall be subject <br />to the approval of the Planning Director, which approval shall be based on factors such <br />as quality, design, and the compatibility of the fencing with the area, including whether or <br />not the fence is consistent with other quality neighborhood boundary fencing that exists <br />or is required by design standards for other properties in the general area. <br /> <br />(c) In order to provide visual and aesthetic variety within the Woodland Park <br />community, townhouse buildings situated next to or across the street from one another <br />will reflect different color schemes for siding and stone color. <br /> <br />(d) The development, at no cost to the City, shall comply with the <br />recommendations, whether on-site or off-site, included in the Traffic Impact Assessment <br />prepared by AES Consulting Engineers dated September 20, 2019, as approved by the <br />City Engineer. <br /> <br />(e) Townhome lots shall be subdivided in accordance with the City’s <br />Subdivision Ordinance prior to obtaining building permits. <br /> <br />(f) The development shall be constructed in compliance with applicable codes, <br />ordinances and regulations of federal, state and local government, and all required <br />licenses and permits shall be obtained and remain in effect during construction of the <br />development. <br /> <br />(g) All taxes/fees associated with the property and/or the proposed use shall <br />be paid when due, as determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />4.
