November 12, 2019 <br /> <br />IT BEING all that certain property conveyed by Deed of Bargain and Sale from <br />Portsmouth Redevelopment and Housing Authority to the Economic Development <br />Authority of the City of Portsmouth, Virginia dated August 30, 2017 and recorded in the <br />Portsmouth Circuit Court Clerk’s Office as Instrument Number 170009045. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The proposed development shall be in substantial compliance with the concept <br />plan entitled Preliminary Plan for Hampton Roads Community Health Center, Portsmouth, <br />Virginia, prepared by Parrish Layne Design Group and dated March 6, 2019, and the <br />rendered concept elevations titled Hampton Roads Community Health Center prepared <br />by Innovate Architecture & Interiors dated April 19, 2019, except where modifications may <br />be required to comply with all applicable local, state, and federal codes and regulations. <br /> <br />(b) Prior to the commencement of construction, a plat vacating all interior lot lines <br />within the property, acceptable in form to the City of Portsmouth and complying with the <br />requirements of the Zoning Ordinance, must be prepared and placed of record in the <br />Circuit Court land records. <br /> <br />(c) Streetscape improvements must be implemented along all street frontages, <br />including those consistent with the High Street Multimodal Corridor, specifically eight (8) <br />foot sidewalks, four (4) foot landscape strips, and two (2) foot buffers. <br /> <br />(d) The facility shall be operated in compliance with applicable codes, ordinances and <br />regulations of federal, state and local government, and all required licenses and permits <br />shall be obtained and remain in effect during operation of the facility. <br /> <br />(e) All taxes/fees associated with the property and/or the proposed use shall be paid <br />when due, as determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br />19 - 401 - Adoption of an ordinance appropriating the sum of $2,000,000 from the <br />Risk Management Fund Balance to the FY 2020 Risk Management Fund budget and <br />transferring the said $2,000,000 from the FY 2020 Risk Management Fund budget <br />to the Pavilion/Mast Canopy Replacement Project in the FY 2020 Capital <br />Improvement Fund budget. <br /> <br />Background: <br /> <br /> <br /> The Atlantic Union Bank Pavilion main mast was deemed deficient in 2018. <br /> <br /> City Council adopted Ordinance 2018-93, which appropriated $2,439,000 to a <br />capital project to complete the following work: fabricate a new canopy; fabricate a new <br />mast; remove the damaged mast; install the replacement mast; and attach the new <br />canopy. <br /> <br /> The original project estimate was $3,000,000. <br /> <br />Discussion: <br /> <br /> As the work continues, staff recommends making other improvements and repairs <br />to make the site safe for occupants, to extend the life of the venue and to improve the <br />experience of event patrons. <br /> <br /> The proposed work includes: painting and resealing the structural steel components; <br />refurbishing and sealing the structural supports; replacing outdoor seating; making <br />electrical repairs; and addressing ADA compliance issues. <br /> <br /> The Engineering team working on the project has evaluated the necessary repairs <br />and rehabilitations. The estimated cost for these additional repairs is 2,000,000. <br /> <br /> <br /> <br /> <br />
