<br /> On motion of Mr. Beamer and seconded by Mrs. Webb, the following resolution was adopted
<br /> on final reading, and by the following vote:

<br /> "A RESOLUTION GRANTING A USE PERMIT TO THE VIRGINIA DISTRICT CONVOCATION OF
<br /> UNt~ED CHURCH OF ~MERICA, INC. TO OPERATE A CHILD CARE CENTER AT THE FORMER
<br /> TRUXTUN ELEMENTARY SCHOOL.
<br />
<br /> WHEREAS, the Virginia i]D~strict Convocation of United Holy Church of America, Inc., by
<br /> George Minor, Jr., attorney, has made application pursuant to ~40-75 (b) of the Code of the
<br /> City of Portsmouth, Virginia, 1973, for the granting of a use permit to operate a child care
<br /> center; and
<br />
<br /> WHEREAS~ the applicant and the Planning Director have done all things required to be done
<br /> in connection with said application; and
<br />
<br /> WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> 1. That the use for which the use permit is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons resid~B or working
<br /> in the neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the property or improv
<br /> ments in the neighborhood; and
<br />
<br /> (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code.
<br />
<br /> 2. The Virginia District Convocation of the United Holy Church of America, Inc. is hereb)
<br /> granted a use permit pursuant to ~40-78 (b) of the City Code to operate a child care center at
<br /> the former Truxtun School which is located on the north side of Elliott Avenue between Deep
<br /> Creek and Frederick Boulevards and described as Tax Plate 181, Parcel 3 (UP-85-16).
<br />
<br /> This use permit is approved subject to the following conditions:
<br />
<br /> (a) A certified land survey must be submitted prior to commencement of operation of the
<br /> facility which shows at least 4,400 square feet of fenced play area.
<br />
<br /> (b) The child care center may be operated with an enrollment of not more than twenty-two
<br /> (22) children to be cared for at the facility at any one time.
<br />
<br /> (C) All interior operations of the facility must be conducted between the hours of 6:00
<br /> a.m. and 6:00 p.m..
<br />
<br /> (d) All outdoor play activities shall be conducted within the fenced paly area and limit~
<br /> to the hours between 8:00 a.m. and 6:00 p.m.
