Beedle to <br />Beach Marine Properties, LLC dated August 29, 2004 and recorded in the Portsmouth <br />Circuit Court Clerk’s Office as Instrument Number 040017559; (2) Deed from The <br />Portsmouth Company to Beach Marine Properties, LLC dated May 28, 2014 and recorded <br />in the Portsmouth Circuit Court Clerk’s Office as Instrument Number 140005554; and (3) <br />Deed from Office of Thrift Supervision, Department of the Treasury, to Beach Marine <br />Properties, LLC dated August 29, 2004 and recorded in the Portsmouth Circuit Court <br />Clerk’s Office as Instrument Number 070020977. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The proposed development shall be in substantial compliance with the plans <br />prepared by B C Architects Engineers with an Engineer’s seal April 12, 2018 and <br />submitted by the applicant, except where modifications may be required to comply with <br />the City’s Ordinance requirements. <br /> <br />(b) The monopole telecommunications tower shall not exceed 150 feet in height <br />measured from the ground surface immediately adjacent to the tower. <br /> <br />(c) The applicant must obtain and keep current any required operating licenses, <br />approvals and permits and shall operate in accordance with all federal, state and local <br />regulations. <br /> <br />(f) All taxes/fees associated with the property and/or the proposed use shall be paid <br />when due, as determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: Battle <br /> <br />- City Manager’s Report - <br /> <br />19 - 229 - Adoption of an ordinance accepting Hazardous Materials Emergency <br />Response Team Cost Recovery funds in the amount of $6,569.89 from the Virginia <br />Department of Emergency Management and appropriating said sum in the FY 2020 <br />Grants Fund for use by the Department of Fire, Rescue and Emergency Services. <br /> <br />Background: <br /> <br /> The Virginia Department of Emergency Management (VDEM) administers all non- <br />disaster/preparedness grant and funding programs available to local government and <br />state agencies. These funding opportunities are used to enhance overall preparedness <br />and response capabilities for the full range of hazards. <br /> <br />Discussion: <br /> <br /> VDEM reimbursed the city the amount of $6,569.89 for HAZMAT Response Cost <br />Recovery calls as the Southside Regional HAZMAT Team Leader. <br /> <br /> The funds received enable Portsmouth, which is the lead city for the Southside <br />Regional Hazardous Materials Team, to maintain a superior level of readiness with regard <br />to equipment, training, and technical expertise in dealing with hazardous materials as <br />required by VDEM. <br /> <br /> These funds are instrumental in ensuring the response capabilities of the <br />Southside Regional Hazardous Materials Emergency Response Team. <br /> <br />Financial Impact: <br /> <br /> The FY 2020 Grants Fund will increase by the said amount. <br /> <br /> <br /> <br /> <br /> <br /> <br />
