June 11, 2019 <br /> <br /> <br /> The text of the predecessor provision to Section 35-72 of the City Code originally <br />included the “May 1” date. However, some time prior to the 1988 recodification the <br />published Code was changed to say “November 1” rather than “May 1”. Based on the <br />research of staff, this change was not made pursuant to any ordinance adopted by City <br />Council. The current published Code is therefore inaccurate; based on the adopted <br /> <br />ordinances of Council, Section 35-72 states “May 1”. <br /> <br />Discussion: <br /> <br /> The draft ordinance presented for Council consideration corrects the textual error <br /> <br />in the published Code. <br /> <br /> The draft ordinance also inserts binding language from Section 58.1-3285 of the <br />Virginia Code and makes some additional minor changes to Section 35-72 for the purpose <br /> <br />of clarity. <br /> <br /> The proposed amendments do not modify or alter the City Assessor’s current <br /> <br />practice regarding the assessment of new improvements. <br /> <br />Financial Impact: <br /> <br /> <br /> None. <br /> <br />Recommended Action: <br /> <br /> Adoption of the ordinance. <br /> <br />Next Steps Following Council Action: <br /> <br /> The City Assessor will continue to perform assessments of new improvements in <br />accordance with existing practice and the City Code. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Clark, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE TO AMEND AND REORDAIN CHAPTER 35 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA (2006), AS AMENDED, BY AMENDING SECTION <br />35-72 (ASSESSMENT OF NEW BUILDINGS; SUBSTANTIALLY COMPLETED) TO <br />CORRECT TEXTUAL ERRORS IN THE PUBLISHED CODE.” <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />- New Business - <br /> <br />19 - 219 - Boards and Commissions <br /> <br />Councilman Moody offered the following nominations: <br /> <br />Economic Development Authority <br />Theresa Saunders-Smith to be appointed to a term ending December 31, 2021, <br />replacing Cathy Revell. <br /> <br />Planning Commission <br />Donna Coleman to be appointed to a term ending December 31, 2020, replacing Janel <br />Hofler. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Clark, to close nominations and the <br />above nominations were adopted by the following vote: <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
