June 11, 2019 <br /> <br />19 - 217 - Adoption of an ordinance to amend and reordain Chapter 22 of the Code <br />of the City of Portsmouth, Virginia (2006), as amended, by amending Section 22- <br />755 (Report by Investigating Officer) to revise the minimum damage threshold <br />requiring preparation of a motor vehicle accident report to accord with Section <br />46.2-373 of the Code of Virginia. <br /> <br />Background: <br /> <br /> Section 46.2-373 of the Code of Virginia establishes a minimum damage threshold <br />that triggers the requirement for investigating police officers to prepare a motor vehicle <br />accident report. <br /> <br /> Section 22-755 of the City Code substantially tracks the language of the Virginia <br />Code. <br /> <br /> In 2009, the Virginia Code was amended to raise the minimum damage threshold <br />from $1,000 to $1,500. <br /> <br /> Section 22-755 of the City Code was last amended in 1992 and has never been <br /> <br />amended to track the State Code increase from $1,000 to $1,500. <br /> <br />Discussion: <br /> <br /> In reviewing the applicable Codes, the Portsmouth Police Department noted the <br />discrepancy between the State and City Code created by the 2009 State Code <br /> <br />amendment. <br /> <br /> <br /> PPD has requested that the City Code be amended to track with the State Code. <br /> <br /> Rather than including a specific dollar amount, the proposed amendment directly <br />references Section 46.2-373 of the State Code. In the future, this will allow the City Code <br /> <br />to track the State Code without requiring additional amendments. <br /> <br />Financial Impact: <br /> <br /> <br /> None. <br /> <br />Recommended Action: <br /> <br /> Adoption of the ordinance. <br /> <br />Next Steps Following Council Action: <br /> <br /> Portsmouth Police Department will implement the amendment. <br /> <br />Motion by Mr. Clark, and seconded by Ms. Lucas-Burke, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE TO AMEND AND REORDAIN CHAPTER 22 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA (2006), AS AMENDED, BY AMENDING SECTION <br />22-755 (REPORT BY INVESTIGATING OFFICER) TO REVISE THE MINIMUM <br />DAMAGE THRESHOLD REQUIRING PREPARATION OF A MOTOR VEHICLE <br />ACCIDENT REPORT TO ACCORD WITH SECTION 46.2-373 OF THE CODE OF <br />VIRGINIA.” <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />19 - 218 - Adoption of an ordinance to amend and reordain Chapter 35 of the Code <br />of the City of Portsmouth, Virginia (2006), as amended, by amending Section 35-72 <br />(Assessment of New Buildings; Substantially Completed) to correct textual errors <br />in the published Code. <br /> <br />Background: <br /> <br /> When construction of a new improvement is completed on a property prior to May <br />1 of a fiscal year, the state and City Code authorize the City Assessor’s Office to perform <br />an assessment of the new improvement so that it can be taxed. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
