March 12, 2019 <br /> <br />At a Regular Meeting of the City Council on Tuesday, March 12, 2019, there were <br />present: <br /> <br />Mayor John L. Rowe, Jr., Vice Mayor Lisa L. Lucas-Burke, William E. Moody, Jr., <br />Elizabeth M. Psimas, Nathan J. Clark, Paul J. Battle, Shannon E. Glover, City Manager <br />Dr. L. Pettis Patton, City Attorney Solomon H. Ashby, Jr. <br /> <br />Dr. Robert Earls opened the meeting with prayer, which was followed by the <br />Pledge of Allegiance to the Flag. <br /> <br /> Mayor Rowe called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to approve the minutes <br />of a Called Meeting of February 23, 2019, of a Called Meeting of February 25, 2019 of a <br />Called Meeting of February 26, 2019, of a Regular Meeting of February 26, 2019, and of <br />a Special Called Meeting of March 8, 2019, and was adopted by the following vote: <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />- Public Hearing - <br /> <br />19 - 96 - Public hearing on rezoning and use permit applications: <br /> <br />(a) Z-19-02 DOWNTOWN AND OLDE TOWNE - Robert P. Beaman III, Esquire, <br />on behalf of Wawa, is requesting to rezone approximately 1. 6 acres <br />located at 700 and 720 London Street on the northeast corner of <br />Effingham Street and London Street from D2-Form Based Code <br />(FBC) and D1-T-4 to General Mixed Use (GMU) in order to construct <br />a 6,000 square foot convenience store with gasoline sales. The <br />property is designated as partially in the Downtown area and partially <br />for Commercial use in the City’s Comprehensive Plan, Build One <br />Portsmouth. The property is owned by Liliben Properties and the <br />American National Red Cross. Planning Commission recommends <br />approval with conditions. <br /> <br />1. Robert Beaman, 222 Central Park Avenue, Virginia Beach, VA, presented the <br />application for both 19-96(a) and 19-96(b). <br /> <br />2. Michael Thornton, 1306 Marshall Avenue, spoke in support of this item. <br /> <br /> Motion by Mr. Moody, and seconded by Ms. Psimas, to concur with the <br />recommendation of the Planning Commission that Z-19-02 be approved on first reading, <br />and was adopted by the following vote: <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />(b) UP-19-02 DOWNTOWN AND OLDE TOWNE - Robert P. Beaman III, <br />Esquire, on behalf of Wawa, is requesting a Use Permit for <br />approximately 1. 6 acres located at 700 and 720 London Street on <br />the northeast corner of Effingham Street and London Street from <br />D2-Form Based Code (FBC) and D1-T-4 to General Mixed Use <br />(GMU) in order to construct a 6,000 square foot convenience store <br />with gasoline sales. A waiver is also requested to allow three (3) <br />points of access rather than the two permitted by the Zoning <br />Ordinance.
