February 26, 2019 <br /> <br />8. Pamela Wilkins, 805 Elm Avenue, spoke in opposition to this item. <br /> <br />9. Paul Bell, 3829 Long Point Boulevard, spoke in opposition to this item. <br /> <br />19-74 - Invitation for bids for a wireless facilities franchise. <br /> <br />There were no additional bids submitted for consideration. <br /> <br />19 - 75 - Public hearing on wireless facilities franchise agreement: <br /> <br /> Adoption of an ordinance accepting the bid submitted by New Cingular Wireless <br />PCS, LLC for a non-exclusive Wireless Facilities Franchise Agreement having a term of <br />ten years with up to three renewal terms of five years each authorizing the placement of <br />wireless facilities within the city’s public ways. <br /> <br />1. Cliff Page, 465 Primrose Street, suggested that the City look into taking controlling <br /> interest of the property once the contract has expired. <br /> <br /> Motion by Mr. Moody, and seconded by Ms. Psimas, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE ACCEPTING THE BID SUBMITTED BY NEW CINGULAR WIRELESS <br />PCS, LLC FOR A NON-EXCLUSIVE WIRELESS FACILITIES FRANCHISE <br />AGREEMENT HAVING A TERM OF TEN YEARS WITH UP TO THREE RENEWAL <br />TERMS OF FIVE YEARS EACH AUTHORIZING THE PLACEMENT OF WIRELESS <br />FACILITIES WITHIN THE CITY’S PUBLIC WAYS.” <br /> <br />Ayes: Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />- Unfinished Business - <br /> <br />19 - 53 - Use permit: <br /> <br /> <br /> Motion by Mr. Clark, and seconded by Ms. Lucas-Burke, to adopt the following <br />resolution approved on first reading at the February 12, 2019 meeting, and was adopted <br />by the following vote: <br /> <br />19-53: <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-19-01) TO MAS-EV PROPERTIES, <br />LLC TO DEVELOP AND OPERATE NOT MORE THAN THREE UNITS OF <br />MULTIFAMILY HOUSING, INCLUDING ONE FIRST FLOOR UNIT, AT 720/722 <br />COUNTY STREET, TAX PARCEL 0025-0260. <br /> <br /> <br />WHEREAS, <br /> MAS-EV Properties, LLC, the owner of the subject property, has <br />made application pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth, <br />Virginia (2006) for the granting of a use permit to develop and operate not more than <br />three units of multifamily housing, including one first floor unit, at 720/722 County Street, <br />Tax Parcel 0025-0260; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1.
