<br /> The City Attorney has previoasly advised that in order t~ enter
<br />;pon such private property for maintenance purposes, the Ci!ty must
<br />~etition the Circuit Court for such authority. The resolutlion on
<br />Tour agenda tonight would authorize the City Attorney to mo~e forwar
<br />~ith such proceedings in the Circuit Court in conjunction with the
<br />other administrative preparations which are being completedl.

<br /> I concur with the request of the City Attorney that th!is reso-
<br />lution be adopted."

<br /> On motion of Mr. Corprew and seconded by Mrs. Lucas, the fol-
<br />lowing resolution was adopted, and by the following vote:
<br />
<br />"A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO PETITION
<br />THE CIRCUIT COURT OF PQRT~MOUT~ TO ENABLE TH~ C'IT¥ TO
<br />MAINTAIN MT. OLIVE CEMETERY, MT. CALVARY CEMETERY, FISHER
<br />CEMETERY, EBONY HEIGHTS CEMETERY AND BARCLAY CEMETERY.
<br />
<br /> WHEREAS, the herein-named cemeteries are private cemeteries
<br />hot owned by any church or the City; and
<br />
<br /> WHEREAS, the owners thereof have abandoned the same and have
<br />allowed the property to fall into a condition of neglect an~ d~suse
<br />so that it is unsightly and thereby lessens the desirabilit~ of
<br />adjacent land; and
<br />
<br /> WHEREAS, the owners have either failed or refused to r~medy
<br />such condition of neglect when requested or the C~ty has bean unable
<br />to contact the owners pertaining to maintenance of said cemeteries;
<br />and
<br />
<br /> WHEREAS, Section 57-39.1, Code of Virginia, 19S0, as amended,
<br />provides that the City may petition the Circuit Court to require the
<br />owners of private cemeteries to place the same in suitable con,
<br />or to allow the petitioner to enter upon the land to place the same
<br />in a suitable condition: and
<br />
<br /> WHEREAS, the City Council deems it to be in zhe best i~terest
<br />of the City to place same cemeteries in suitable condition.]
<br /> NOW, THEREFORB, BE IT RESOLVED by the Council of the City of
<br />Portsm?uth, Virginia, that the City Attorney be, and he hereby is,
<br />authorized to petition the Circuit Court of Portsmouth, pur~uagt to
<br />Section S7-39.1, Code of Virginia, to enable the City to maintain
<br />~t. Olive Cemetery, Mt. Calvary Cemetery, Fisher Cemetery, Ebony
<br />Heights Cemetery and Barclay Cemetery."

<br /> "On May 13, 1986, the City Council adopted a Resolution creatiz
<br />the Sports Authority of Hampton Roads, Virginia by the joint actions
<br />of the Councils of the Cities of Hampton, Newport News, Portsmouth,
<br />Norfolk, Virginia Beach, Chesapeake and Suffolk, ~irginia a~d the
<br />Board of Supervisors of Isle of Wight County as provided ~o' in the
<br />applicable provisions of the State Code. Subsequent to the
<br />of that Resolution and the creation of the Sports Authority|and the
<br />adoption of its Articles of Incorporation, the City of Virginia
<br />Beach requested that the Artizles if Inzorporatio~ be amended to
