November 27, 2018 <br /> <br /> <br /> The Virginia Code requires that such unsolicited proposals be treated as proposals <br />under the Virginia Public-Private Education and Infrastructure Act of 2002, as amended <br />(Va. Code §§ 56.575-1 through 56.575-18) (the PPEA). <br /> <br /> As required by the PPEA, the City has adopted its own guidelines for PPEA <br />proposals (as last revised in December 2010, the City Guidelines). <br /> <br /> In accordance with the PPEA and the City Guidelines, the City gave public notice <br />of the receipt of the unsolicited proposal and invited the submission of proposals by other <br />offerors. <br /> <br /> One additional proposal was received but it was subsequently withdrawn. <br /> <br />Discussion: <br /> <br /> The City has requested the initial offeror to provide additional information about <br />its proposal. <br /> <br /> Once the additional information has been received it will be necessary to analyze <br />the proposal to determine the advantages, disadvantages, costs and benefits for the City. <br /> <br /> Under Section 56.575-3(C)(1) of the Virginia Code and the City Guidelines, Council <br />has the authority to direct City staff to perform the analysis of the proposal (as opposed <br />to solely utilizing outside consultants). <br /> <br /> Given that the proposal addresses development of the type of facilities which staff <br />currently operates and with which staff is intimately familiar, it is advisable for staff to <br />perform the analysis. <br /> <br />Financial Impact: <br /> <br /> <br /> N/A <br /> <br />Recommended Action: <br /> <br /> <br /> Adoption of the resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> City staff will analyze the proposal. <br /> <br />1. Donna Sayegh, 3104 Garland Drive, spoke in opposition to this item. <br /> <br />Motion by Ms. Psimas, and seconded by Mr. Clark, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION DIRECTING THAT AN ANALYSIS OF PROPOSALS RECEIVED FOR <br />THE CONSTRUCTION OF A NEW CITY HALL AND A NEW PUBLIC SAFETY <br />BUILDING BE CONDUCTED BY CITY STAFF. <br /> <br />WHEREAS, <br /> in May 2018 the City received an unsolicited proposal for the <br />construction of a new City Hall and a new Public Safety Building; and <br /> <br />WHEREAS, <br /> the proposal was received in accordance with the Virginia Public- <br />Private Education and Infrastructure Act of 2002, as amended (Va. Code §§ 56.575-1 <br />through 56.575-18) (PPEA) and the Public-Private Infrastructure Act of 2002-Guidelines <br />of the City of Portsmouth, revised December 2010 (the City Guidelines); and <br /> <br />WHEREAS, <br /> as required by the PPEA and the City Guidelines the City gave public <br />notice of the receipt of the proposal and provided the opportunity for other interested <br />parties to submit competing proposals; and <br /> <br />WHEREAS, <br /> the City received one additional proposal; and <br /> <br />WHEREAS, <br /> the City has requested that the offerors provide additional detailed <br />information for the purpose of analyzing the proposals; and <br /> <br />WHEREAS, <br /> the City Guidelines and§ 56.575-3(C)(1) of the PPEA provide that <br />City Council may direct City staff to perform the required analysis of the competing <br />proposals prior to negotiation with the selected proposer and presentation of a proposed <br />comprehensive agreement for Council approval; and <br /> <br /> <br /> <br /> <br />
