That the special exception to be granted: <br /> <br /> (~) Will not adversely affect the health and safety of <br />~ersons residing or working in the neighborhood; <br /> <br /> (b) Will not be detrimental to the public use or injurious <br />o the property or improvements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes and objectives of <br />,he Downtown D-1 District and the Zoning Chapter of the City Code. <br /> <br /> 2. The American Bank Building located at 444 Crawford Street <br />.s hereby granted a special exception to the off-street parking <br />requirements in the Downtown D-1 District as provided for in ~40-12 <br />(b) (IV) by the granting of a variance of all required parking space <br />such special exception being approved subject to the following <br /> <br />:onditions: <br /> <br /> (a) The American Bank Building will preside two (2) on-siC <br />~arking spaces. <br /> <br /> (b) The American Bank Building will lease two (2) additio~ <br />~arking spaces at an cfr-site parking facility." <br /> <br /> (c) "A RESOLUTION GRANTING APPROVAL EOR A GROUP HOUSING <br /> PROJECT PURSUANT TO SECTION 40-88 OE THE C£DE OF THE <br /> CITY OF PORTSMOUTH, VIRGINIA, 1975, ON A .62 ACRE <br /> PARCEL BOUNDED BY HIGH STREET ON THE NORTH, WATER <br /> STREET ON tHE EAST, A PROPOSED PARKING GARAGE ON THE <br /> SOUTH, AND CRAWFORD STREET ON THE WEST. <br /> <br />WHEREAS, Portsmouth Parkside Development Associates has made <br />application pursuant to §40-SS of the Code of the City of Portsmouth <br /> inia, 1978, as amended, for the granting and approval of a <br />housing project consisting of forty (40) condominium units and 8,80[ <br />square feet of retaiI commercial space on the ground floor within a <br />five and one-half story structure on a parcel bounded by High Street <br />on the north, Water Street on the east, Crawford Street on the west <br />and a proposed parking garage on the south, such group housing pro- <br /> ect having been designated as GHP-86-S; and <br /> <br /> WHEREAS, the applicant has been determined by the Planning <br /> ommission to have me~ the requirements of ~40-SS of the Code of <br />the City of Portsmouth, Virginia, 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application <br />and site plans submitted ~herewith and has recommended a conditional <br />approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of a <br />group housing project pursuant to ~40-SS grants only sn exemption <br />from certain reqoirements for residences as stated in said section <br />and does not conslitUte a waiver of any other recuirements embodied <br />in the Subdivision Ordinance, Zoning Ordinance, -Code of the City of <br />Portsmouth, Virginia, or any other applicable local, state or feders <br />law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits or any <br /> other required permit will be issued only upon compliance with the <br /> ordinances, laws, or regulations applicable thereto. <br /> <br /> <br />
