<br />At a Regular Meeting of the City Council on Tuesday, August 14, 2018, there were
<br />present:
<br />
<br />Mayor John L. Rowe, Jr., Vice Mayor Elizabeth M. Psimas, William E. Moody, Jr., Ray A.
<br />Smith, Sr., Dr. Mark M. Whitaker, Nathan J. Clark, Lisa L. Lucas-Burke, City Manager Dr.
<br />L. Pettis Patton, City Attorney Solomon H. Ashby, Jr.
<br />
<br />Pastor Robert Lee opened the meeting with prayer, which was followed by the
<br />Pledge of Allegiance to the Flag.
<br />
<br /> Mayor Rowe called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Ms. Lucas-Burke, and seconded by Mr. Smith, to approve the minutes
<br />of a Called Meeting of July 23, 2018, of a Called Meeting of July 24, 2018, and of a
<br />Regular Meeting of July 24, 2018, and was adopted by the following vote:
<br />
<br />Ayes: Clark, Lucas-Burke, Moody, Psimas, Smith, Whitaker, Rowe
<br />Nays: None
<br />
<br />- Public Hearing -
<br />
<br />18 - 311 - Public hearing on use permit and rezoning applications:
<br />
<br />(a) UP-18-04 DOWNTOWN - Edward Walker requests a Use Permit at 467 Court
<br />Street for an entertainment establishment. The property is currently
<br />zoned Downtown, D-1 (T-5). The Comprehensive Plan recommends
<br />mixed use downtown development. Planning Commission
<br />recommends approval with conditions.
<br />
<br />1. Edward Walker, 467 Court Street, applicant, spoke in support of this item.
<br />
<br /> Motion by Mr. Clark, and seconded by Mr. Smith, to concur with the
<br />recommendation of the Planning Commission that UP-18-04 be approved on first reading,
<br />and was adopted by the following vote:

<br />Ayes: Clark, Lucas-Burke, Moody, Psimas, Smith, Whitaker, Rowe
<br />Nays: None
<br />
<br />(b) Z-18-02 LAUREL PARK – C. Raeford Eure, on behalf of 3600 Forest Haven
<br />Lane, LLC, requests a proffered rezoning of 3600 Forest Haven
<br />Lane. The property is currently zoned General Residential, GR. The
<br />proposed zoning is Conditional General Mixed Use, GMU-K. The
<br />Comprehensive Plan recommends low to medium density single-
<br />family development. Planning Commission recommends approval
<br />with proffers.
<br />
<br />1. Raeford Eure, 901 Port Centre Parkway, applicant, spoke in support of this item.
<br />
<br />2. John Doyle, 3621 Forest Haven Lane, spoke in support of this item.
<br />
<br /> Motion by Mr. Smith, and seconded by Mr. Clark, to concur with the
<br />recommendation of the Planning Commission that Z-18-02 be approved on first reading
<br />with the additional proffers, and was adopted by the following vote:
<br />
<br />Proffers:
<br />1. To extend the twenty (20’) foot rear yard buffer that exists on all residential lots that
<br />are contiguous to First Team Toyota.
<br />
<br />2. That all trees, east of the extended fencing, that exist today will remain unless they
<br />are damaged by storm, disease or insects and become a hazard to the surrounding
<br />property.
