Sound financial policy is to cover increase in operational expenses with savings <br />from other expenditure accounts or with increases from additional current year revenue. <br /> <br /> The proposed ordinance will transfer $450,000 from the Non-Departmental line <br />items of the FY 2018 General Fund Budget to the City Attorney Legal Contractual <br /> <br />Services line item of the FY 2018 General Fund Budget. <br /> <br />Financial Impact: <br /> <br /> There is no impact to fund balance as the transfer is between budgeted categories <br /> <br />of the General Fund. <br /> <br />Recommended Action: <br /> <br /> <br /> Adoption of the ordinance. <br /> <br />Next Steps Following Council Action: <br /> <br /> The Finance Department will complete the necessary budget adjustments. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Clark, to adopt the following ordinance, <br />and was adopted by the following vote: <br /> <br />“ORDINANCE AUTHORIZING THE TRANSFER OF $450,000 FROM UNEXPENDED <br />NON-DEPARTMENTAL LINE ITEMS IN THE FY 2018 GENERAL FUND BUDGET TO <br />THE CITY ATTORNEY LEGAL CONTRACTUAL SERVICES LINE ITEM IN THE FY <br />2018 GENERAL FUND BUDGET.” <br /> <br /> <br />Ayes: Clark, Lucas-Burke, Moody, Psimas, Smith, Whitaker, Rowe <br />Nays: None <br /> <br />18 - 161 - Adoption of an ordinance amending Ordinance 1978-133 titled “An <br />Ordinance Closing the Following Street: A Portion of Newport Avenue” for the <br />purpose of correcting a patent error in the legal description included in said <br />ordinance. <br /> <br />Background: <br /> <br /> On December 12, 1978 City Council adopted a street closure ordinance <br />(Ordinance 1978-133) purporting to close Newport Avenue between High Street and King <br />Street. <br /> <br /> The legal description of the closure area included in the ordinance encompassed <br />the area directly east of Newport Avenue, and did not encompass any portion of Newport <br />Avenue. <br /> <br /> The legal description was a clear and obvious error. <br /> <br /> After adoption of the closure ordinance in 1978, the area of Newport Avenue <br />between High Street and King Street was physically closed and discontinued as a public <br />street, and the area has since been incorporated into other parcels. <br /> <br /> The error in the legal description in Ordinance 1978-133 was recently discovered <br />by a title company, and the owner of the properties into which Newport Avenue has been <br />incorporated has requested that City Council take action to correct the prior ordinance. <br /> <br />Discussion: <br /> <br /> Ordinance 1978-133 can be corrected by adopting a new ordinance amending the <br />legal description, effective as of the date of adoption of the original ordinance. <br /> <br /> Adoption of the amendment will correct a title issue created by the original error, <br />and legal title will now match what the City and the property owners have assumed to be <br />the case since 1978. <br /> <br />Financial Impact <br /> <br /> <br /> None. <br /> <br />Recommended Action: <br /> <br /> <br /> Adoption of the ordinance. <br /> <br /> <br /> <br /> <br />
