October 14, 1986 WHEREAS, a public hearing has been held with respect to the ent ~o the Articles of Incorporation of the Authority. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of ortsmouth, Virginia: 1. That it does hereby approve the foregoing recitals which deemed to be incorporated herein as part of this resolution as fully set forth herein. 2. That it does hereby amend, currently with the cities of Hampton, Newport News, Norfolk, Virgmnma Beach, Chesapeake,and Suffolk and the County of Isle of Wight, the Articles of Incorpora- tion of the Authority by adding the following provisions as an ~dditional Paragraph 6: 'Paragraph 6. Unless sooner dissolved in accordance with the provisions of Section 15.1-1286.1 of the Code of Virginia, 1950, as amended, the Authority shall be dissolved on December 31, 2090; provided, however, in the event there are any outstanding obligations of the Authority on such date, the Authority shall be dissolved on the date on which the last of such outstanding obli- gations shall have been fully paid or discharge. 3. Except as heremn amended, the Articles of Incorporation of he iuthority shall remain ~n full force and effect. 4. This resolution will be effective provided the Councils of the Cities of Hampton, Newport News, Norfolk, Virginia Beach, Chesapeake, and Suffolk and the Board of Supervisors of the County of Isle of Wight adopt similar resolutions or ordinances amending the Articles of Incorporation of the Authority as set forth above." Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holle Nays: None 86-366 Letter from the City Manager recommending adoption of a resolution author~zigg the City Manager to release a 10' drainage easement in Section 3, Elizabeth Acres. "When Section 3 of Elizabeth Acres was developed in 1959, the developer established a 10' drainage easemen~ along the rear lot lines of lots 83 through 92 of this subdivision. The present pro- perty owners have petitioned the City for release of the drainage easement so that the property may be used by the individual property owners. The City Engineer and Director of Public Works have indicated that the easement is no~ required for drainage purposes ~n this ares of the City. I recommend adoption of the resolution on your agenda tonight to authorize the issance of release deeds as requested by the pro- ~erty owners." On motion of Mrs. Webb and seconded by Mrs. Lucas, the followir -esolution was adopted, and by the following vcte: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE A 10' DRAINAGE EASEMENT IN SECTION S, ELIZABETH ACRES. WHEREAS, by plat recorded in Map Book 3, page 62, in the Clerk' Office of the Circuit Court of the City of Portsmouth, Virgmnia, thc developer of Elizabeth Acres, Section 3, dedicated a certain draina easement, ten feet (10') in width, along the boundary of lots 83 through 92 of said subdivision; and
