October 14, 1986 <br /> <br />WHEREAS, a public hearing has been held with respect to the <br />ent ~o the Articles of Incorporation of the Authority. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />ortsmouth, Virginia: <br /> <br /> 1. That it does hereby approve the foregoing recitals which <br /> deemed to be incorporated herein as part of this resolution as <br />fully set forth herein. <br /> <br /> 2. That it does hereby amend, currently with the cities of <br />Hampton, Newport News, Norfolk, Virgmnma Beach, Chesapeake,and <br />Suffolk and the County of Isle of Wight, the Articles of Incorpora- <br />tion of the Authority by adding the following provisions as an <br /> ~dditional Paragraph 6: <br /> <br />'Paragraph 6. Unless sooner dissolved in accordance <br />with the provisions of Section 15.1-1286.1 of the Code <br />of Virginia, 1950, as amended, the Authority shall be <br />dissolved on December 31, 2090; provided, however, in <br />the event there are any outstanding obligations of the <br />Authority on such date, the Authority shall be dissolved <br />on the date on which the last of such outstanding obli- <br />gations shall have been fully paid or discharge. <br /> <br /> 3. Except as heremn amended, the Articles of Incorporation of <br />he iuthority shall remain ~n full force and effect. <br /> <br /> 4. This resolution will be effective provided the Councils of <br />the Cities of Hampton, Newport News, Norfolk, Virginia Beach, <br />Chesapeake, and Suffolk and the Board of Supervisors of the County <br />of Isle of Wight adopt similar resolutions or ordinances amending <br />the Articles of Incorporation of the Authority as set forth above." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holle <br />Nays: None <br /> <br /> 86-366 Letter from the City Manager recommending adoption of <br />a resolution author~zigg the City Manager to release a 10' drainage <br />easement in Section 3, Elizabeth Acres. <br /> <br /> "When Section 3 of Elizabeth Acres was developed in 1959, the <br />developer established a 10' drainage easemen~ along the rear lot <br />lines of lots 83 through 92 of this subdivision. The present pro- <br />perty owners have petitioned the City for release of the drainage <br />easement so that the property may be used by the individual property <br />owners. <br /> <br /> The City Engineer and Director of Public Works have indicated <br />that the easement is no~ required for drainage purposes ~n this ares <br />of the City. <br /> <br /> I recommend adoption of the resolution on your agenda tonight <br />to authorize the issance of release deeds as requested by the pro- <br />~erty owners." <br /> <br /> On motion of Mrs. Webb and seconded by Mrs. Lucas, the followir <br /> -esolution was adopted, and by the following vcte: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE A <br />10' DRAINAGE EASEMENT IN SECTION S, ELIZABETH ACRES. <br /> <br /> WHEREAS, by plat recorded in Map Book 3, page 62, in the Clerk' <br />Office of the Circuit Court of the City of Portsmouth, Virgmnia, thc <br />developer of Elizabeth Acres, Section 3, dedicated a certain draina <br />easement, ten feet (10') in width, along the boundary of lots 83 <br />through 92 of said subdivision; and <br /> <br /> <br />
