March 13, 2018 <br /> <br />“ORDINANCE ACCEPTING AID-TO-LOCALITIES FUNDING RECEIVED DURING FY <br />2015 FROM THE VIRGINIA DEPARTMENT OF FIRE PROGRAMS IN THE AMOUNT <br />OF $15,748 AND APPROPRIATING SAID FUNDS IN THE GRANTS FUND FOR USE <br />BY THE DEPARTMENT OF FIRE, RESCUE AND EMERGENCY SERVICES TO <br />SUPPORT FIRE AND EMERGENCY SERVICES IN THE CITY.” <br /> <br />Ayes: Clark, Moody, Psimas, Smith, Whitaker, Rowe <br />Nays: None <br /> <br />18 - 111 - Adoption of an ordinance appropriating $43,529,573 by classification to <br />the FY 2018 Operating Budget for the Portsmouth Public Schools to implement the <br />fourth quarter of the annual budget. <br /> <br />Background: <br /> <br /> On May 9, 2017, City Council approved the FY 2018 School Board Operating <br />Budget of $192,985,789 and adopted the first quarterly budget operating appropriation of <br />$43,529,572 and $18,867,500 for the fiscal year for the grant fund. On September 27 <br />and December 12 2017, City Council approved the second and third quarterly budget of <br /> <br />$43,529,572 each. <br /> <br /> Funding for the fourth quarter of the school budget from April 1, 2018 - June 30, <br /> <br />2018 must now be appropriated. <br /> <br />Discussion: <br /> <br /> Beginning with the FY2015 Budget, City Council has made quarterly <br /> <br />appropriations of the Portsmouth Public Schools Budget. <br /> <br />Financial Impact: <br /> <br /> Funds are appropriated in the city’s FY 2018 general fund to pay for the local <br />contribution to the school system. The attached ordinance implements the fourth quarter <br />amount. <br /> <br />Staff Recommends: <br /> <br /> Adoption of the ordinance. <br /> <br />Next Steps Following Council Action: <br /> <br /> The Finance Department and the Schools will complete the necessary budget <br /> <br />adjustments. <br /> <br />Motion by Ms. Psimas, and seconded by Mr. Moody, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE APPROPRIATING $43,529,573 BY CLASSIFICATION TO THE FY 2018 <br />OPERATING BUDGET FOR THE PORTSMOUTH PUBLIC SCHOOLS TO IMPLEMENT <br />THE FOURTH QUARTER OF THE ANNUAL BUDGET. ” <br /> <br />Ayes: Clark, Moody, Psimas, Smith, Whitaker, Rowe <br />Nays: None <br /> <br />18 - 112 - Adoption of a resolution abolishing the Americans with Disabilities <br />Commission. <br /> <br />Background: <br /> <br /> Title II of the Americans with Disabilities Act (the “Act”) requires public entities with <br />fifty or more employees to establish a grievance procedure for resolution of complaints <br />by members of the public alleging that the public entity is discriminating on the basis of <br />disability. <br /> <br /> In 1992, City Council adopted a Resolution creating the Americans with Disabilities <br />Commission for the purpose of complying with the grievance procedure requirement of <br />the Act. <br /> <br /> The City has subsequently adopted revised Administrative Policy #21 which <br />provides for a different grievance structure, rendering the ADA Commission unnecessary. <br /> <br /> <br /> <br /> <br />
