February 27, 2018 <br /> <br />ALL THAT certain lot, piece or parcel of land, with the buildings and improvements <br />thereon, situate, lying and being in the City of Portsmouth, Virginia, and labeled <br />“Disposition Parcel 191” on that certain plat titled “Resubdivision of Disposition Parcel <br />191/Crawford Urban Renewal Project/for Portsmouth Redevelopment and Housing <br />Authority” prepared by Hoggard/Eure Associates, P.C., dated July 30, 2002, and recorded <br />in the Portsmouth Circuit Court Clerk’s Office in Map Book 19 at Page 60. <br /> <br />The said parcel is generally described as bounded by Chestnut Street on the west, King <br />Street on the north, Effingham Street on the east, and County Street on the south. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development of the site shall be in substantial conformity with the concept plan <br />labeled 818 County Street prepared by D. E. Weatherby & Associates dated September <br />19, 2017 submitted with the application and on file in the Department of Planning, except <br />as may be necessary to comply with any modifications required by City Ordinances and <br />the City Code during site plan review and approval. <br /> <br />(b) The design and materials of buildings constructed shall be in substantial conformity <br />with the “Exterior Elevations” dated September 19, 2017 and revised on October 13, 2017 <br />prepared by D. E. Weatherby & Associates and on file in the Department of Planning. <br /> <br />(c) The site and building design and construction shall comply with at least 4 of the <br />Green Building features identified as “Schedule B” in Table 40.1-5.8(F), Green Building <br />Bonuses, of the Zoning Ordinance. <br /> <br />(d) No first floor residential dwelling unit shall front on Effingham Street. <br /> <br />(e) All required operating licenses, approvals and permits shall be obtained timely and <br />maintained, and the development shall be operated in compliance with all federal, state <br />and local laws and regulations. <br /> <br />(f) All taxes/fees associated with the property and/or the proposed use shall be paid <br />when due. <br /> <br />4. That, without limitation of any other condition stated herein, it is expressly <br />understood that the residential unit density of 31.4 dwelling units per acre provided for <br />through this Use Permit is authorized on the condition that the development be <br />constructed with Green Building features as provided in condition 3(c) hereinabove. <br /> <br />REVOCATION OF PERMIT: <br />5. Violation of any of the above conditions may <br /> <br />serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Lucas-Burke, Moody, Smith, Whitaker <br />Nays: Clark, Psimas, Rowe <br /> <br />- City Manager’s Report - <br /> <br />18 - 90 - Adoption of an ordinance accepting a grant in the amount of $10,650 from <br />the Virginia Department of Motor Vehicles and appropriating said funds in the FY <br />2018 Grants Fund for use by the Portsmouth Police Department to purchase speed <br />measurement devices. <br /> <br />Background: <br /> <br /> The Portsmouth Police Department has been awarded grant funding in the amount <br />of $10,650.00 from the Virginia Department of Motor Vehicles. <br /> <br />Discussion: <br /> <br /> The funds received will enable the Portsmouth Police Department to provide <br />payments for speed measurement devices (i.e. Radars / LIDAR’s) to be utilized during <br />our check points and saturation patrols throughout the city. <br /> <br /> <br /> <br /> <br />
