Octo'ber 28, 1986 <br /> <br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN <br />PROPERTY OWNED BY HOWARD W. DREW, JR., AND MARY F. DREW, <br />UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO THE CHARTER <br />OF THE CITY OF PORTSMOUTH, SAID PROPERTY BEING NECESSARY <br />FOR THE CONSTRUCTION, ALTERATION AND WIDENING OF MIMOSA <br />ROAD. <br /> <br /> WHEREAS, the C~uncil of the City of Portsmouth has determined <br />it to be in the public interest to reconstruct, alter and widen <br />Mimosa Road; and <br /> <br /> WHEREAS, the City has found it necessary to acquire fee simple <br />interest in and to the hereinafter-described parcel of land situate <br />in the City of Portsmouth, Virginia, for the said purpose of recon- <br />structing, altering and widening Mimosa Road; and <br /> <br /> WHEREAS, the City has not been able to purchase the property <br />described herein, necessary to the project, because the owners <br />thereof and the City have not been able to agree upon the price to <br />be paid therefor; and <br /> <br /> WHEREAS, the advancement of the work and the use of said pro- <br />perty will be unreasonably delayed if said property is not made <br />available for the project as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> That the City Attorney be, and he hereby is, directed to <br />institute eminent domain proceedings against the hereinafter-des- <br />cribed property situate in the City of Portsmouth, Virginia, for thc <br /> ose of acquiring fee simple title therein, together with any an~ <br />all easements of access, light or air incident to the lands of the <br />landowner abutting upon s&id property, in accordance with, and pur- <br />suant to, Section 2.06, 2.07 and 2.08 of the Charter of the City of <br />Portsmouth, Virginia, as amended, and to deposit to the credit of <br />the Clerk of the Circuit Court of the City of Portsmouth as provide~ <br />by law the sum hereinafter specified to compensate the owners of thc <br />property designated as parcel 001 on that certain plat entitled <br />"Plat Showing Proposed Right-of-Way Acquisition for Mimosa Road <br />Street Improvements" dated October 20, 1985, prepared by the Engi- <br />neering & Technical Services Department of the City of Portsmouth, <br /> iinia, a copy of which plat is attached hereto and made a part <br />hereof. <br /> <br />The name of the property owners are Howard W. Drew, Jr., and <br />F. Drew. <br /> <br /> The amount to be deposited to the credit of the Clerk of the <br />Circuit Court of the City. of Portsmouth is $1,000.00." <br /> <br />Ayes: Corprew, Gray, Lucas, Simpson, Webb, Holley <br />Nays: None <br /> <br /> 86-392 v Lette~ £ro~ the City Manager recommending adoption of <br />a reslution to appoint viewers fo~ closing of a portion of a ten <br />foot alley on the east side of Peninsula Avenue between Barton Stree <br />and Spratley Street. <br /> <br /> ',Carl V. Lun~quist has made application to close a portion of <br /> ten foot alley on the east side of Peninsula Avenue between Barror <br />treet and Spratley Street. <br /> <br /> The attached resolution appoints viewers in accordance with <br /> ~licable State Law to view the portion of such street and to re- <br />>orr to the Planning Commission if any inconvenience would result <br /> said closing. <br /> <br /> I, therefore, <br />esolutlon. <br /> <br />concur and recommend the adoption of the attache~ <br /> <br /> <br />
