Louise Lucas, <br />J. Herbert Simpson, Gloria O. Webb, George L. Hanbury, <br />City Manager, Steven Lieberman, City Attorney. <br /> <br />Absent: Jack P. Barnes, E. G. Corprew, Jr. <br /> <br />86-381 - The £9~tgwing call for-the ~eeting~was read: <br /> <br /> "Please attend a special meeting of the City Council to be hel <br />in the Council Chamber, 6th floor of City Hall, 801 Crawford Street <br />at 4:30 p.m. on Tuesday, October 28, 1986, for the purpose of a <br />~ublic work session on an appeal from the Commission of Architectur <br /> <br /> In addition, you may consider a motion to go into an executive <br />sesslon. <br /> <br />By order of the Mayor." <br /> <br />86-382 A public work session was held for an appeal from <br />and Mrs. Martin Bright regarding a decision of the Commission <br />of Architectural Review for Pert Norfolk and Park View made on <br />October 6, 1986 concerning 6S5 Florida Avenue. <br /> <br />Ernest Freeman, City Planner, made a presentation. <br /> <br />Kathleen Bright made a presentation. (See Exhibit 86-382 <br />Councilman Corprew arrived for the public work session at 4:54 <br />Motion of Mrs. Lucas and seconded by Mrs. Webb, as follows: <br /> <br /> "The City Council recognizes that a hardship has been placed <br />upon the Brights based upon their reliance upon the prior policy of <br />the Commission of Architectural Review which allowed the covering <br />of facia, soffits and eaves with vinyl and/or aluminum. This prior <br />policy was explaned to the Brights in June 1.of 1985 by the City <br />Planning staff. The Brights proceeded to obtain financing and con- <br />tracted to have the whole house covered in reliance on this June, <br />1985 expl~natiio~ of the Commission's policy in effect at that time. <br /> <br /> In recognition of this hardship, the Council of the City of <br />Portsmouth by a 6-0 vote overturns the Commission of Architectural <br />Review's decision of October 6, 1986 and allows the Brights to cove~ <br />the soffit, eave and trim areas with vinyl or aluminum." <br /> <br />As stated above the motion was adopted by 6-0 vote. <br /> <br /> 86-383 - Motion of Mr. Gray and seconded by Mrs. Lucas, to go <br />into an executive session in accordance with Section 2.1-344 of the <br />Code of Virginia to discuss the following: <br /> <br />1. The condition, acqusition and use of real property for <br /> purposes as permitted under subsection (a) (2); <br /> <br /> 2. Consultation with City <br />embers pertaining to actual or <br />~atters within the jurisdiction <br />subsection (a) (6); <br /> <br />Attorney and briefing by sta~[ <br />potential litigation or other legal <br />of City Council as permitted under <br /> <br />On motion was adopted by 6-0 vote. <br /> <br />On <br /> <br />motion meeting adjourned. <br /> <br />City <br /> <br /> 3, Consideration of appointments by the City Council as per- <br />mitted under subsection (a) (1). <br /> <br /> <br />
