May 23, 2000 (d) This use permit shall not be transferable. (e) All exterior signage and changes to the facility must be reviewed and approved by the Downtown Design Committee. (f) All taxes in connection with the property and the proposed operation shall be paid when due. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Ayes: Benn, Griffin, Moody, Whitehurst, Holley Nays: None Motion by Mr. Whitehurst, and seconded by Mr. Benn, to adopt the following resolution, approved at the May 9, 2000 meeting, and was adopted by the following vote: 00-109(d): "A RESOLUTION GRANTING A USE PERMIT TO FRANCES W. STEWARD FOR THE OPERATION OF A RETAIL TOY STORE AT 231 HIGH STREET. WHEREAS, Frances W. Steward has made application pursuant to Section 40- 43.1 of the Code of the City of Portsmouth, Virginia (1988), for a use permit to operate a Retail Toy Store (S.I.C. 59) at 231 High Street, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for an amended use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Frances W. Steward is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a Retail Toy Store on property located at 231 High Street, and being more particularly described as: UP-00-09 Beginning at a point 74.66'+ east of the intersection of Middle Street and High Street; thence, in an easterly direction 8'+ to a point; thence, in a southerly direction 30'+ to a point; thence, in a westerly direction 8'+ to a point; thence, in a northerly direction 30'+ to a point of the beginning.
