May 23, 2000 <br /> <br />(d) This use permit shall not be transferable. <br /> <br /> (e) All exterior signage and changes to the facility must be reviewed and <br />approved by the Downtown Design Committee. <br /> <br /> (f) All taxes in connection with the property and the proposed operation shall <br />be paid when due. <br /> <br /> REVOCATION OF PERMIT: Violation of any of the above conditions may serve <br />as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Whitehurst, Holley <br />Nays: None <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Benn, to adopt the following <br />resolution, approved at the May 9, 2000 meeting, and was adopted by the following <br />vote: <br /> <br />00-109(d): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO FRANCES W. STEWARD FOR <br />THE OPERATION OF A RETAIL TOY STORE AT 231 HIGH STREET. <br /> <br /> WHEREAS, Frances W. Steward has made application pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (1988), for a use permit to operate a <br />Retail Toy Store (S.I.C. 59) at 231 High Street, Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of the <br />application for an amended use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing <br />or working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property <br />or improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility <br />with surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for <br />parking, driveways, and curb cuts which will provide for safe and convenient traffic <br />movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth <br />Zoning Ordinance. <br /> <br /> 2. That Frances W. Steward is hereby granted a use permit pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation <br />of a Retail Toy Store on property located at 231 High Street, and being more particularly <br />described as: <br /> <br />UP-00-09 <br /> <br />Beginning at a point 74.66'+ east of the intersection of Middle Street and <br />High Street; thence, in an easterly direction 8'+ to a point; thence, in a <br />southerly direction 30'+ to a point; thence, in a westerly direction 8'+ to a <br />point; thence, in a northerly direction 30'+ to a point of the beginning. <br /> <br /> <br />
