May 23, 2000 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a boat dock at 104 City Park Avenue, Portsmouth, Virginia, and being more particularly described as: UP-00-07 Beginning at a point on the south right-of-way of Clifford Street, said point being the mean Iow water mark of Baines Creek and the true point of beginning; thence west along the south right-of-way of the proposed Clifford Street 1,000+; thence west along the south right-of-way of the proposed Clifford Street extension (formerly the Seaboard Coastline Railroad right-of-way) 2,380+ to the center of a creek inlet; thence meandering north along the mean Iow water line of said creek inlet, Olive Branch Cemetery and City Park 3,000+; thence meandering east along the mean Iow water line of the Western Branch of the Elizabeth River and City Park 2,000+; thence meandering south along the mean Iow water line of Baines Creek and City Park 2,000+ to the true point of the beginning. 3. That this use permit is approved subject to the following conditions: (a) to construction. Ayes: Benn, Griffin, Moody, Whitehurst, Holley Nays: None Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following ordinance, approved at the May 9, 2000 meeting, and was adopted by the following vote: 00-109(b): "AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING TABLE 40-43.1-2 AND SECTION 40-34.4 THEREOF PERTAINING TO WEDDING CHAPELS AND TABLE 40-44-2 THEREOF PERTAINING TO ACCESSORY STRUCTURES."
