December 12, 2017 <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Cherry, to concur with the <br />recommendation of the Planning Commission that CA-17-04 be approved on first reading, <br />and was adopted by the following vote: <br /> <br />Ayes: Cherry, Clark, Lucas-Burke, Moody, Whitaker, Rowe <br />Nays: None <br /> <br />17-534Invitation for bids for a wireless facilities franchise. <br /> - <br /> <br />There were no additional bids submitted for consideration. <br /> <br />17 - 535 - Public hearing on wireless facilities franchise agreement: <br /> <br /> Adoption of an ordinance accepting the bid submitted by Mobilitie, LLC for a non- <br />exclusive wireless facilities franchise agreement having a term of ten years with up to <br />three renewal terms of five years each authorizing the placement of wireless facilities <br />within the city’s public ways. <br /> <br />1. Candace Slade, 2736 Stan Hope Avenue, Norfolk, spoke in support of this item. <br /> <br />2. Mark Geduldig-Yatrofsky, P. O. Box 50141, voiced his concern with several items in <br /> the appendix of the proposed ordinance and asked that City Council defer <br /> consideration to a later date. <br /> <br /> Motion by Ms. Lucas-Burke, and seconded by Mr. Clark, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE ACCEPTING THE BID SUBMITTED BY MOBILITIE, LLC FOR A NON- <br />EXCLUSVIVE WIRELESS FACILITIES FRANCHISE AGREEMENT HAVING A TERM <br />OF TEN YEARS WITH UP TO THREE RENEWAL TERMS OF FIVE YEARS EACH <br />AUTHORIZING THE PLACEMENT OF WIRELESS FACILITIES WITHIN THE CITY’S <br />PUBLIC WAYS.” <br /> <br />Ayes: Cherry, Clark, Lucas-Burke, Moody, Whitaker, Rowe <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br />17 - 536 - Adoption of an ordinance accepting a donation of $20,000 to the City from <br />the Elizabeth River Project and appropriating said funds to the FY 2018 Grants <br />Fund for use for the continued development of Paradise Creek Nature Park. <br /> <br />Background: <br /> <br /> On September 26, 2006, City Council adopted Resolution R-06-48 authorizing the <br />city to enter into an Agreement with ERP concerning the creation of Paradise Creek <br />Nature Park, and on August 23, 2011 and July 12, 2016 City Council adopted Resolutions <br />R-11-23 and R-16-19, respectively, authorizing amendments to the Agreement. <br /> <br /> The creation of the Nature Park has transformed what was once a blighted and <br />environmentally challenged area into a natural and educational resource for the citizens <br />of Portsmouth and the region. <br /> <br /> In 2006, the city was awarded a Land and Water Conservation Fund Grant in the <br />amount of $168,550 to build the Dominion Wetland Learning Lab and Kayak Launch; <br />Elizabeth River Project provided the 50-50 cash match for the grant. <br /> <br /> The Kayak Launch and Learning Lab were completed in 2016. <br /> <br /> In 2015, the city was awarded an additional $118,930 to construct a nature themed <br />playground and a picnic shelter, again Elizabeth River Project provide the 50-50 cash <br />match. <br /> <br /> Recent cost projections show the project will be approximately $20,000 over <br />budget. <br /> <br /> <br /> <br /> <br /> <br /> <br />
