August 22, 2017 <br /> <br />PARCEL TWO: <br />All that certain lot, piece or parcel of land with the buildings and improvements thereon <br />and the appurtenances thereunto belonging, lying, being and situate in the City of <br />Portsmouth, Virginia and being described as follows: <br /> <br />Beginning at the southeast intersection of Court Street and High Street and running <br />thence east along High Street 110 feet, more or less, to the land conveyed to Legnab, <br />Inc. by deed recorded in the Clerk’s Office of the Circuit Court of the City aforesaid in <br />Deed Book 546 at page 40; thence south and parallel with Court Street 68.1 feet, more <br />or less, to land conveyed to Stanley G. Bangel and Herbert K. Bangel by deed duly <br />recorded in the Clerk’s Office aforesaid in Deed Book 307, at page 369, thence west and <br />parallel with High Street, 110 feet, more or less, to the east side of Court Street; thence <br />68.1 feet more or less along the east side of Court Street to its intersection with High <br />Street, the point of beginning. <br /> <br />IT BEING the same property conveyed to Progressive Portsmouth, LLC by Deed of <br />Contribution from Richard D. Levin and Richard D. Ricks dated March 16, 2007 and <br />recorded in the Portsmouth Circuit Court Clerk’s Office as Instrument Number <br />070007032. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The number of dwelling units in the development shall not exceed 27. <br /> <br />(b) The applicant shall obtain approval for all exterior improvements, including <br />signage, from the Downtown Design Committee. <br /> <br />(c) The development shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local government, including, but not limited to, the Virginia <br />Uniform Statewide Building Code. In addition, the applicant shall install an automatic fire <br />sprinkler system, as required by the City Building Official. <br /> <br />(d) All taxes/fees associated with the property and/or the proposed use shall be paid <br />when due. <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the above conditions may <br /> <br />serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Cherry, Clark, Lucas-Burke, Moody, Whitaker, Rowe <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br />17 - 363 - Adoption of an ordinance accepting Four-For-Life Program grant funds <br />in the amount of $74,941.36 from the Virginia Department of Health, Office of <br />Emergency Medical Services and appropriating said funds in the FY 2018 Grants <br />Fund for use by the Department of Fire, Rescue and Emergency Services. <br /> <br />Background: <br /> <br /> The Four-For-Life program, as amended in 2000, stipulates that four additional <br />dollars be charged and collected at the time of registration of each passenger vehicle, <br />pickup and panel truck. <br /> <br /> The funds collected, pursuant to Section 46.2-694, Code of Virginia, shall be used <br />only for emergency medical services. <br /> <br /> The Code of Virginia further states that the Department of Health shall return <br />twenty-six percent (26%) of the vehicle registration fees collected to the locality wherein <br />such vehicle is registered. <br /> <br />Discussion: <br /> <br /> The program funds allow for the purchase of necessary equipment and supplies in <br />support of the emergency medical service delivery. <br /> <br /> <br /> <br /> <br />
