August 22, 2017 PARCEL TWO: All that certain lot, piece or parcel of land with the buildings and improvements thereon and the appurtenances thereunto belonging, lying, being and situate in the City of Portsmouth, Virginia and being described as follows: Beginning at the southeast intersection of Court Street and High Street and running thence east along High Street 110 feet, more or less, to the land conveyed to Legnab, Inc. by deed recorded in the Clerk’s Office of the Circuit Court of the City aforesaid in Deed Book 546 at page 40; thence south and parallel with Court Street 68.1 feet, more or less, to land conveyed to Stanley G. Bangel and Herbert K. Bangel by deed duly recorded in the Clerk’s Office aforesaid in Deed Book 307, at page 369, thence west and parallel with High Street, 110 feet, more or less, to the east side of Court Street; thence 68.1 feet more or less along the east side of Court Street to its intersection with High Street, the point of beginning. IT BEING the same property conveyed to Progressive Portsmouth, LLC by Deed of Contribution from Richard D. Levin and Richard D. Ricks dated March 16, 2007 and recorded in the Portsmouth Circuit Court Clerk’s Office as Instrument Number 070007032. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The number of dwelling units in the development shall not exceed 27. (b) The applicant shall obtain approval for all exterior improvements, including signage, from the Downtown Design Committee. (c) The development shall comply with all applicable codes, ordinances and regulations of federal, state and local government, including, but not limited to, the Virginia Uniform Statewide Building Code. In addition, the applicant shall install an automatic fire sprinkler system, as required by the City Building Official. (d) All taxes/fees associated with the property and/or the proposed use shall be paid when due. REVOCATION OF PERMIT: 4. Violation of any of the above conditions may serve as grounds for revocation of the use permit by City Council.” Ayes: Cherry, Clark, Lucas-Burke, Moody, Whitaker, Rowe Nays: None - City Manager’s Report - 17 - 363 - Adoption of an ordinance accepting Four-For-Life Program grant funds in the amount of $74,941.36 from the Virginia Department of Health, Office of Emergency Medical Services and appropriating said funds in the FY 2018 Grants Fund for use by the Department of Fire, Rescue and Emergency Services. Background:  The Four-For-Life program, as amended in 2000, stipulates that four additional dollars be charged and collected at the time of registration of each passenger vehicle, pickup and panel truck.  The funds collected, pursuant to Section 46.2-694, Code of Virginia, shall be used only for emergency medical services.  The Code of Virginia further states that the Department of Health shall return twenty-six percent (26%) of the vehicle registration fees collected to the locality wherein such vehicle is registered. Discussion:  The program funds allow for the purchase of necessary equipment and supplies in support of the emergency medical service delivery.
