August 22, 2017 <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Occupancy of the child day care center shall be limited to no more than fifteen (15) <br />children. The center shall not provide care for any more than five (5) children under the <br />age of 2 ½ years at any one time. <br /> <br />(b) The days and hours of operation for the child day care center activities shall be <br />Monday through Friday commencing no earlier than 6:00 a.m. and ending no later than <br />6:00 p.m. <br /> <br />(c) Outdoor play shall be limited to Monday through Friday no earlier than 8:00 a.m. <br />to no later than 6:00 p.m. The proposed outdoor play area shall comply with Portsmouth <br />City Code Section 40.1-4.3(B)(1)(iii). The proposed outdoor play area shall be located to <br />the rear of the building and be configured so that children do not have to cross vehicular <br />travelways to enter or exit the play area. <br /> <br />(d) The applicant shall maintain at least four (4) parking spaces within the church <br />parking area for the drop-off/pick-up of children and staff parking. The spaces shall be <br />configured so that children do not have to cross vehicular travelways to enter or exit the <br />child day care center facility. <br /> <br />(e) Prior to the issuance of the Zoning Clearance for the use, the applicant shall obtain <br />the approval of a plan drawn to scale that provides a code-compliant outdoor play area <br />and the required parking in support of the facility. <br /> <br />(f) The facility shall be operated in compliance with applicable codes, ordinances and <br />regulations of federal, state and local government, including, but not limited to, the Virginia <br />Uniform Statewide Building Code and all required licenses and permits shall be obtained <br />and remain in effect, and shall be complied with, during the operation of the child day care <br />center. <br /> <br />(g) The applicant shall obtain a Certificate of Occupancy specific to the child day care <br />center prior to commencing operations. <br /> <br />(h) All taxes/fees associated with the property and/or the proposed use, if any, shall <br />be paid when due. <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the above conditions may <br /> <br />serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Clark, Lucas-Burke, Moody, Whitaker, Rowe <br />Nays: None <br />Abstain: Cherry (Member of Zion Baptist Church) <br /> <br /> Motion by Ms. Lucas-Burke, and seconded by Mr. Moody, to adopt the following <br />resolution approved on first reading at the August 8, 2017 meeting, and was adopted by <br />the following vote: <br /> <br />17-340(b): <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-17-07) TO NEW KIRN <br />DEVELOPMENT, LLC TO DEVELOP AND OPERATE NOT MORE THAN 27 UNITS OF <br />MULTIFAMILY HOUSING AT 325-327 HIGH STREET AND 341 HIGH STREET. <br /> <br /> <br />WHEREAS, <br /> New Kirn Development, LLC, the contract purchaser of the subject <br />property, has made application pursuant to Section 40.1-2.3B of the Code of the City of <br />Portsmouth, Virginia (2006) for the granting of a use permit to develop and operate not <br />more than 27 units of multifamily housing at 325-327 and 341 High Street, Portsmouth, <br />Virginia; and <br /> <br /> <br /> <br /> <br /> <br /> <br />
