August 22, 2017 <br /> <br /> <br /> In addition, the Department of Parks, Recreation, and Leisure Services will fully <br />implement the USDA Summer Food Service Program throughout the summer of 2017. <br /> <br />Motion by Dr. Whitaker, and seconded by Ms. Lucas-Burke, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE ACCEPTING A GRANT IN THE AMOUNT OF $419,364.41 FROM THE <br />VIRGINIA DEPARTMENT OF HEALTH AND APPROPRIATING SAID FUNDS IN THE <br />FY 2018 GRANTS FUND FOR USE BY THE DEPARTMENT OF PARKS, <br />RECREATION & LEISURE SERVICES FOR THE USDA SUMMER FOOD SERVICE <br />PROGRAM.” <br /> <br />Ayes: Cherry, Clark, Lucas-Burke, Moody, Whitaker, Rowe <br />Nays: None <br /> <br />17 - 365 - Adoption of an ordinance to amend and reordain Chapter 4 (Animals) of <br />the Code of the City of Portsmouth, Virginia (2006) by amending subsection (f) of <br />Section 4-9 for the purpose of modifying the requirements for tethering of dogs. <br /> <br />Background: <br /> <br /> Currently the City Code states that it is unlawful to tether a dog for more than three <br />consecutive hours during any twenty-four hour period. <br /> <br /> The “three consecutive hour” limit effectively requires law enforcement to observe <br />a tethered dog for over three hours prior to issuing a citation. <br /> <br /> This is an inefficient use of law enforcement resources and has rendered the <br />tethering time limits in the Code unenforceable. <br /> <br />Discussion: <br /> <br /> It is proposed to amend the City Code to require that the owner of any tethered <br />dog must be, at all times, (1) outside with the dog and (2) within thirty-five feet of the dog. <br /> <br />Financial impact: <br /> <br /> None. <br /> <br />Recommended Action: <br /> <br /> Adoption of the ordinance. <br /> <br />Next Steps Following Council Action: <br /> <br /> The public will be notified of the new tethering rules. <br /> <br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, asked that there be some <br />accommodation to allow for momentary absences for citizens who may have a dog <br />tethered outside. <br /> <br />2. Chris Fontes, 305 Douglas Avenue, spoke in support of this item. <br /> <br />3.
