July 25, 2017 <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in the <br />zoning district(s) of surrounding lands; <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in the zoning districts; and <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br /> 2. That Safe Harbor Behavioral Health Care LLC is hereby granted a use <br />permit pursuant to Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia <br />(2006) to operate a residential and outpatient drug and alcohol treatment facility at 2700 <br />London Boulevard, Portsmouth, Virginia, being more particularly described as: <br /> <br />UP-17-03 <br /> <br />2700 London Boulevard <br />(Tax Parcel 0158-0930) <br /> <br />ALL THAT certain lot, piece or parcel of land, consisting of 76,782.7 square feet or <br />1.76269 acres, with the improvements thereon and appurtenances thereto belonging, <br />situate in the City of Portsmouth, State of Virginia, as shown upon that certain plat entitled <br />“Plat Showing Survey of Property Located at Northwest Corner of London Blvd. & Broad <br />Street Portsmouth, Virginia for E.V.M.A.”, dated December 8, 1982, made by Hassell & <br />Folkes, P.C., Surveyors & Engineers, Portsmouth, Virginia, which said plat is recorded <br />with that certain Deed by and between Aubrey G. Sweet, Aubrey G. Sweet, Jr. and Ruth <br />O. Sweet, his wife, and Eastern Virginia Medical Authority, dated December 28, 1982, <br />and recorded in the Clerk’s Office of the Circuit Court of the City of Portsmouth, Virginia <br />in Deed Book 843, at Page 85. <br /> <br />IT BEING all that certain property conveyed to The L. Louise Lucas Trust by Deed from <br />Southside Direct Care Provider, L.L.C. dated December 24, 2009 and recorded in the <br />Portsmouth Circuit Court Clerk’s Office as Instrument Number 100000010. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The applicant shall maintain at least fifty-four (54) parking spaces for the substance <br />abuse treatment facility. <br /> <br />(b) The parking area shall be striped and shall incorporate signage to comply with the <br />requirements of the Department of Engineering. <br /> <br />(c) The existing landscaping, including shrubbery and mature tree canopy, shall be <br />maintained. <br /> <br />(d) The existing dumpster shall be appropriately screened in accordance with the <br />standards of the Zoning Ordinance. <br /> <br />(e) The existing fencing shall be maintained and replaced when it is in disrepair. <br /> <br />(f) The applicant shall obtain a sign permit for all signage replacement, or for the <br />establishment of new signage. <br /> <br /> <br /> <br /> <br /> <br />
