Also, in connection with Environmental <br />Protection Agency requirements, the area must be secured by a fence <br />for a certain period of time. There, it has become necessary to <br />close a portion of the r~ght-of-way. <br /> <br /> ABEX Corporation, by its local attorney, has made application <br />for this street closure and has advertised the notice as required <br />by law. <br /> <br /> The attached resolution would appoint viewers as requested by <br />this application. I recommend approval of the resolution." <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following <br />resolution was adopted, and by the following vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS F2R THE CLOSING OF PORTIONS <br />OF BRISHTON STREET AND SEVENTH STREET. <br /> <br /> WHEREAS, ABEX Corporation has made application to vacate, close <br />discontinue the hereinafter portions of Brighton Street and <br />Seventh Street; and it appearing that notice of application and <br />request for the appointment of viewers has been duly advertised as <br />required by law. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that Richard D. Ottavio, Simon P. Arrington, <br />Robert McCurdy, James V. McGehee and Raymond Tweed be appointed <br /> -and tha~ Moses Gibson and George N. Powers, Sr., be appo~nte <br />~lternate ~iewers in the event one of the preceding vzewers fails <br />to particiFate, said ~iewers to view the hereinafter-described <br />sortions of such streets and to report to this Council in writing <br /> ~er in their opinion any, and if any what, inconvenience would <br />result in vacating and closing the following: <br /> <br /> <br />
