133 December 9, 1986 Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holle' Nays: None 86-453 Letter from the City Manager recommending adoption of and ordinance to amend the Code to establish a $25.00 viewers fee for street closure applications. 'The present fee for street closing viewers as established by City Council many years ago is $10.00 per street. The fee is paid directly to the viewers by the applicant requesting the street clos~ This fee is in addition to the 2100.00 processing fee paid ~o the City for each application. Section 15.1-364, Code of Virginia, provides that the locality may establish the fee for viewers, not so exceed 550.00 per viewer. The City Attorney has recommended that this fee schedule be incorporated in the City Code. I recommend approval of the ordinance establishing the fee at $25.00 per viewer." On motion of Mr. Barnes and secondeJ by Mr. Gray, the followin~l ~rdinance was adopted on first and final reading, and by the followql ing vote: "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTION 32-25 PERTAINING TO STREET CLOSURE APPLICATIONS." Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb; Holley Nays: None 86-454 Letter from the City Manager recommending adoption of resolution requesting the Gene,ral Assembly of Virginia amend the Charter of the City of P6rtsmouth by repealing the section Dertainiz to the Office of the Clerk of the Circuit Court. 'Section 6.05 of the City Charter provides that the OfFice of the Clerk of the Circuit Court shall be a City office. Fun~s for the operation of this office have been generated from the f~es and commissions collected by the Clerk and deposited in the City Treasu~ Due to recent increases in salaries and expenses of th~ office,. it has become apparent that the projected fees and commissions will ti not be sufficient to continue to fund this office without additiona~l City supplements. Arrangements have been made with the Sta~e Compensation Board to assume the operation and funding of the Clerk Office effective July 1, 1987. Arrangements have also beenimade to continue the present retirement benefits for employees Of t~e Clerk Office at no additional cost to the City. I recommend adoption of the resolution requesting the ~eneral Assembly to amend the City Charter by repealing Section 6~0~ pert-' aining to the Office of the Clerk of the Circuit Court." ~ On motion of Mr. Simpson and seconded by Mrs. Lucas, t~e folto~ ina resolution Was adopted, and by the following vote: ',A RESOLUTION REQUESTING THE GENERAL ASSEMBLY OF VIRGINIA TO AMEND TH~ CHARTER OF THE CITY OF PORTSMOUTH, VIRGINIA. i WHEREAS, Section 1S.1-835, Code of Virginia, 19S0, as ~mended, ~rovides for the amendment of the City Charter upon the holding of public hearing to determine if the citizens of the City d~sire th~ the amendment to the City Charter be granted, and by forwarding thereafter a request to one or more members of the General ~ssembly representing the City to introduce the proposed change as a ibill in the succeeding session of the General Assembly; and
