133 <br /> <br />December 9, 1986 <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holle' <br />Nays: None <br /> <br /> 86-453 Letter from the City Manager recommending adoption of <br />and ordinance to amend the Code to establish a $25.00 viewers fee <br />for street closure applications. <br /> <br /> 'The present fee for street closing viewers as established by <br />City Council many years ago is $10.00 per street. The fee is paid <br />directly to the viewers by the applicant requesting the street clos~ <br />This fee is in addition to the 2100.00 processing fee paid ~o the <br />City for each application. <br /> <br /> Section 15.1-364, Code of Virginia, provides that the locality <br />may establish the fee for viewers, not so exceed 550.00 per viewer. <br /> <br /> The City Attorney has recommended that this fee schedule be <br />incorporated in the City Code. <br /> <br /> I recommend approval of the ordinance establishing the fee at <br />$25.00 per viewer." <br /> <br /> On motion of Mr. Barnes and secondeJ by Mr. Gray, the followin~l <br />~rdinance was adopted on first and final reading, and by the followql <br />ing vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTION 32-25 PERTAINING TO <br />STREET CLOSURE APPLICATIONS." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb; Holley <br />Nays: None <br /> <br /> 86-454 Letter from the City Manager recommending adoption of <br />resolution requesting the Gene,ral Assembly of Virginia amend the <br />Charter of the City of P6rtsmouth by repealing the section Dertainiz <br />to the Office of the Clerk of the Circuit Court. <br /> <br /> 'Section 6.05 of the City Charter provides that the OfFice of <br />the Clerk of the Circuit Court shall be a City office. Fun~s for <br />the operation of this office have been generated from the f~es and <br />commissions collected by the Clerk and deposited in the City Treasu~ <br /> <br /> Due to recent increases in salaries and expenses of th~ office,. <br />it has become apparent that the projected fees and commissions will ti <br />not be sufficient to continue to fund this office without additiona~l <br />City supplements. Arrangements have been made with the Sta~e <br />Compensation Board to assume the operation and funding of the Clerk <br />Office effective July 1, 1987. Arrangements have also beenimade to <br />continue the present retirement benefits for employees Of t~e Clerk <br />Office at no additional cost to the City. <br /> <br /> I recommend adoption of the resolution requesting the ~eneral <br />Assembly to amend the City Charter by repealing Section 6~0~ pert-' <br />aining to the Office of the Clerk of the Circuit Court." ~ <br /> <br /> On motion of Mr. Simpson and seconded by Mrs. Lucas, t~e folto~ <br />ina resolution Was adopted, and by the following vote: <br /> <br /> ',A RESOLUTION REQUESTING THE GENERAL ASSEMBLY OF VIRGINIA TO <br /> AMEND TH~ CHARTER OF THE CITY OF PORTSMOUTH, VIRGINIA. i <br /> <br /> WHEREAS, Section 1S.1-835, Code of Virginia, 19S0, as ~mended, <br /> ~rovides for the amendment of the City Charter upon the holding of <br /> public hearing to determine if the citizens of the City d~sire th~ <br />the amendment to the City Charter be granted, and by forwarding <br />thereafter a request to one or more members of the General ~ssembly <br />representing the City to introduce the proposed change as a ibill in <br />the succeeding session of the General Assembly; and <br /> <br /> <br />
