March 28, 2017 <br /> <br />“RESOLUTION AUTHORIZING PARCEL RECONCILIATION FOR THE MARTIN <br />LUTHER KING FREEWAY EXTENSION PROJECT THROUGH THE CONVEYANCE <br />OF VARIOUS INTERESTS IN RIGHTS OF WAY AND OTHER RESIDUAL <br />PROPERTIES BETWEEN THE CITY OF PORTSMOUTH AND THE COMMONWEALTH <br />OF VIRGINIA. <br /> <br /> WHEREAS, <br /> the Martin Luther King (MLK) Freeway Extension Project (0058-965- <br />107, RW101, UPC 76642) expanded the state-owned roadway between London <br />Boulevard and I-264; and <br /> <br /> WHEREAS, <br />the area of the MLK Extension includes several privately-owned <br />parcels which the Commonwealth of Virginia (acting through the Virginia Department of <br />Transportation (VDOT)) acquired, as well as several areas which were formerly City rights <br />of way, including without limitation portions of the former Harbor Drive, Trexler Avenue, <br />and Bedford Street (collectively, the “City Property Interests”); and <br /> <br />WHEREAS, <br /> the City has not yet formally conveyed the City Property Interests to <br />VDOT; and <br /> <br />WHEREAS, <br /> as part of its acquisitions for the MLK Extension VDOT acquired <br />property for new or relocated City rights of way necessitated by the project, including a <br />portion of Trexler Avenue and road sections for the connection of King Street and County <br />Street, as well as certain additional residual property (collectively, the “VDOT Property <br />Interests”); and <br /> <br />WHEREAS, <br /> VDOT has not yet conveyed the VDOT Property Interests to the City; <br />and <br /> <br />WHEREAS, <br /> for purposes of clarity of title and responsibility it is advisable to <br />perform a parcel reconciliation for the MLK Extension Project through conveyance of the <br />City Property Interests to VDOT and conveyance of the VDOT Property Interests to the <br />City; <br /> <br /> NOW THEREFORE, BE IT RESOLVED <br />, by the Council of the City of Portsmouth, <br />Virginia, that: <br /> <br /> 1. The City Manager is authorized to execute and deliver one or more Deed\[s\] <br />and/or other instruments or agreements which are necessary or desirable to convey the <br />City Property Interests to the Commonwealth of Virginia and/or VDOT. <br /> <br />2. The City Manager is authorized to accept and execute on behalf of <br />the City one or more Deed\[s\] and/or other instruments or agreements which are <br />necessary or desirable to convey the VDOT Property Interests to the City. <br /> <br />3. The conveyances authorized by this Resolution shall not be <br />construed to close or vacate any existing right of way. <br /> <br /> <br />4.
