March 28, 2017 <br /> <br />Background: <br /> <br /> The Martin Luther King (MLK) Freeway Extension Project (0058-965-107, RW101, <br />UPC 76642) expanded the State roadway between London Boulevard and I-264. <br /> <br /> The area in which the MLK Extension was constructed includes segments of city <br />streets and portions of residential properties acquired by the Virginia Department of <br />Transportation (VDOT). <br /> <br /> When roadway projects include the extension of right of way and property <br />acquisition for new rights of way, VDOT and the affected locality traditionally execute legal <br />instruments to memorialize the new right way, transfer new or relocated road segments <br />to the locality, and transfer residual property to the locality. This is sometimes called <br /> <br />parcel reconciliation. <br /> <br /> Parcel reconciliation is beneficial because it clarifies title and responsibility as <br /> <br />between the City and the State. <br /> <br />Discussion: <br /> <br /> The proposed Resolution will authorize the City Manager to execute deeds <br />conveying VDOT title to former city streets which are now located within the area of MLK <br /> <br />Extension. <br /> <br /> The proposed Resolution will also authorize the City Manager to accept title to <br />areas acquired by VDOT adjacent to the MLK Extension which are now intended to serve <br />as new or relocated city rights of way, or which are residual parcels not needed for the <br /> <br />MLK project. <br /> <br /> The right of way for the MLK Extension encompasses the former Harbor Drive <br />between the London Boulevard Bridge and Turnpike Road. This right of way will be <br /> <br />transferred to VDOT. <br /> <br /> Several parcels of land within the same corridor that were acquired by VDOT will <br />be transferred back to the city of Portsmouth as road segments connecting King Street <br /> <br />and County Street and as residual property. <br /> <br /> Trexler Avenue in North Truxtun was reconstructed for the configuration of the exit <br />at Frederick Boulevard. An existing portion of the Trexler Avenue will be transferred to <br />VDOT. The reconstructed portion of Trexler Avenue and residual property adjacent to it <br /> <br />will be transferred to the city of Portsmouth. <br /> <br /> A portion of right of way formerly known as Bedford Street off of Columbus Avenue <br />is now part of a stormwater management facility for the new Freeway Extension. This <br /> <br />right of way will be transferred to VDOT. <br /> <br />Financial Impact: <br /> <br /> There will be minimal impacts to the city streets maintenance inventory starting in <br />FY 2019 when the roadway segments are reconciled. <br /> <br /> There are no funds associated with the transfer of residual property as long as the <br />city of Portsmouth maintains ownership and the properties are used for public benefit. If <br />the properties are sold, then the city of Portsmouth must pay fair market value to VDOT. <br /> <br />Recommended Action: <br /> <br /> Adoption of the resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> Execute legal instruments and proceed with property transfers. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Psimas, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
