January 13, 1987 <br /> <br /> The adoption of the enclosed ordinance would repeal the manda- <br />tory retirement age provisions of our Supplemental Retirement <br />System for all employees except those employed in a bona fide execu- <br />tive or high policy making position as those positions are execmpt <br /> the Age Discrimination And Employment Act. In addition, it <br /> ~hould be noted that no changes are rec_uired in the P~tice ~d~-Fire <br /> irement System since £irefighters and law enforcement officers <br /> ~re exempt from the provisions of the Federal Act. <br /> <br /> I recommend adoption of the enclosed ordinance." <br /> <br /> On motion of Mrs. Webb and seconded by Mr. Barnes, the <br /> inance was adopted on first and final reading, and by the follow- <br />ing vote: <br /> <br /> "AN ORDINANCE TO ~END THE CODE OF THE CITY OF PORTSMOUTH, <br /> VIRGINIA, 1973, BY REPEALING SECTION 2-18 AND AMENDING <br /> SECTION 31-262 (b) PERTAINING FO RETIREMENT AGE." <br /> <br />Ayes: Barnes, CorFrew, Gray, Lucas, Simpson, Webb, Holle~ <br />Nays: None <br /> <br /> 87-5 Letter from the City Manager r¢comending adoption of a~ <br />ordinance to close a port,on of Bay Street. <br /> <br />"Portsmouth Boating Center, Inc., smd Christian Broadcasting <br /> made application to close a portion of Bay Street. <br /> <br />Viewers were appointed by City Council and have reported that <br />no inconvenience would result to adjoining property owners. Subse- <br /> uent to the Planning Commission's vote (3;3), we met ~ith the <br /> ~licants, and they F~v~ agreed to the following conditions: <br /> <br /> 1. A perpetual easement, privilege and right-of-way to install <br />operate, maintain and replace electric power lines and telephone <br />lines be reserved for the City. <br /> <br /> 2. For the benefi~ of citizens, the right of egress and ingre~ <br />along the closed street during the hours of o~eration of the adja- <br /> ent marina shall be reserved for public use. <br /> <br />3. The right of ingress and egress shall include, but not be <br />imited to, the right of temporary tying of boats at the end of the <br /> ~erty for the purpose of loading and unloading of pleasure boats <br /> <br />4. The right Of ingress and egress shall specifically not <br />nclude the right of persons to fish, crab or swim on or adjacent <br /> the subject property. <br /> <br /> I, therefore, recommend adoption of the attached ordinance <br />closing a portion of Bay Street. ' <br /> <br /> George G. Joyner, III, 324 Londong Boulevard, representing <br />Portsmouth Boating Center, requested for adoption of the ordinance <br /> <br /> Rev. Jim Hundley, 1023 Naval Avenue, President of Park View <br />Civic League, spoke in opposition of the closing of Bay Street and <br />requested that the matter be denied or deferred until the Park View <br />Civic League has complete information on the plans For the Park Vie~ <br />waterfront. <br /> <br /> Motion of Mr. Simpson and seconded by Mrs. Lucas, to approve <br />the ordinance. <br /> <br /> Substitute motion of Mr. Barnes and seconded by Mrs. Webb, to <br />defer the matter to the regular meeting of February 10, 1987, and <br />was adopted by 6-1(Nay-SimFson\) vote. <br /> <br /> <br />
