The use permit is approved subject to the following zonditions: a. 'A final subdivision plat pertaining to the property in uestion be approved prior to issuance of a building permit. b. The facility be limited to a maximum of one hundred (100) residents of any one time. c. The applicant shall comply with all applicable codes, ordinances, policies and regulations of federal, state and local overnments. d. A site plan be submitted for review and approval by he Planning staff showing a passive recreation area for the exteri of the facility along with a written description of planned exterio] ~ctivities." Norman, Executive )irector of the Portsmouth Community Services Board, has made appli cation pursuant to ~40-70 (b) of the Code of the City of Portsmouth ttVirginia, as amended, for the granting of a use permit as herein- after-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done fn connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not affect the health and safety of oersons g or working in the neighborhood of the orooosed use; (b) Will not be detrimental to the public use or injuriou~ the property or improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. The Portsmouth Communi~ty Services Board is hereby granted la use permit pursuant to ~-0'-70 (b) of the Code of the City of I~ortsmouth, Virginia, to operate a group home for mentally retarded
