January 27, 1987 Lewis Thomas, 131 Florida Avenue, representing Port Norfolk ivic League, spoke in opposition to the changes in code amendment. Harry DeHart, 551 Florida Avenue, spoke in opposition of the code amendment. Anne McGl?nn, $64 MiddIe Street, representing Olde Towne Civic League, stated that the Olde Towne Civic League opposed the amend- ~ent unanimously. On motion of Mrs. Webb and seconded by Mr. Gray, CA 86-11 be approved on first reading, as revised, (no waivers of parking vari- ances in any of the 5 Historic Districts), and was adopted by the following vote: Ayes: Lucas, Simpson, Webb, Holley Nays: Barnes, Corprew, Gray Mayor Holley recognized Councilman J. HerberL-~Simpson on being inducted into the Tidewater Virginia Amateur Softball Association Hall of Fame, and others who were honored. UNFINISHED BUSINESS - Consent Agenda On motion of Mr. Gray and seconded by Mrs. Webb, the following items approved on first reading at the Public Hearing and r6~ular meeting of January 10, 1987, were adopted on final reading, and by the following vote: 87-3 - Use permit and group housing applications, and Code amendment: Ca) "A RESOLUTION GRANTING A USE PERMIT TO HAROLD BEAVER TO OPERATE A GROUP HOME FOR ADULTS ON PROPERTY LOCATED ON THE NORTH SIDE OF AIRLINE BOULEVARD BETWEEN LANCER DRIVE AND YORKSHIRE ROAD. WHEREAS, Harold Beaver, contractor owner, has made application ~ursuant to [40-71 (b) of the Code of the City of Portsmouthl ¢irginia, as amended,'for the granting of a use permit as h&rein- · £ter-described; and WHEREAS, the applicant and the Planning Director have done ali ~hings required to be done in connecticn with said application; and WHEREAS, the Planning Commission has recommended the grant'ing said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for whi:h the use permit is sought: (a) Will not affect the health and safety of persons residing or working in the neighborho>d of the proposed use¢ (bl Will not be detrimental to the public use or injurious to the property or improvements ~n the neighborhood; and (c) Will be in accord with the purposes of the Zoning Shapter of the City Code. 2.
