September 13, 2016 <br /> <br />At a Regular Meeting of the City Council on Tuesday, September 13, 2016, there <br />were present: <br /> <br />Mayor Kenneth I. Wright, Vice Mayor Elizabeth M. Psimas, William E. Moody, Jr., Paige <br />D. Cherry, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, Dr. Mark M. Whitaker, City <br />Manager Dr. L. Pettis Patton, City Attorney Solomon H. Ashby, Jr. <br /> <br />Pastor Kolbi Shartzer opened the meeting with prayer, which was followed by the <br />Pledge of Allegiance to the Flag. <br /> <br /> Mayor Wright called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Moody, and seconded by Dr. Edmonds, to approve the minutes of <br />a Called Meeting of August 23, 2016, and of a Regular Meeting of August 23, 2016, and <br />was adopted by the following vote: <br /> <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright <br />Nays: None <br /> <br /> <br /> Police Chief Chapman recognized Officer Vince McClain and Officer Ann O’Neal as <br />recipients of the Mother Against Drunk Driving Southeastern ASAP and Chesapeake <br />Bay ASAP 2016 Law Enforcement Awards. <br /> <br />- - <br /> Public Hearing <br /> <br />16 - 283 - Public hearing on use permit, rezoning and code amendment applications: <br /> <br /> <br />(a) UP-16-08 CAVALIER MANOR - Ashley Solt, representing Herman & Kittle <br />Properties, Inc., is requesting a use permit to construct 280 <br />multifamily apartment units in 22 buildings on approximately 13.8 <br />acres located at 4358 Greenwood Drive. The property is zoned <br />Urban Residential – High (UR-H) and the density of development <br />proposed would be 20.3 dwelling units to the acre. The property is <br />owned by CB Richard Ellis of Virginia, Inc. (CBRE) and designated <br />on the City’s Comprehensive Plan Future Land Use Map for <br />Multifamily Residential Uses. Vision Principles: A Robust and <br />Prospering Economy and Sustainable Neighborhoods. <br /> <br />1. Ray Smith, 1227 Darren Drive, spoke in opposition to this item. <br /> <br />2. Robert Barclay, 200 High Street, Suite 500, spoke in support of this item. <br /> <br />th <br />3. Michael Roderer, 500 East 96 Street, Indianapolis, IN, spoke in support of this item. <br /> <br />4. Joe Wright, 1451 Welcome Road, spoke in opposition to this item. <br /> <br />Motion by Ms. Psimas, and seconded by Mr. Moody, to deny item UP-16-08 on <br />first reading, and was adopted by the following vote: <br /> <br />Ayes: Cherry, Meeks, Moody, Psimas, Wright <br />Nays: Edmonds <br />Councilman Whitaker recused himself from voting on this item. <br /> <br /> There was a consensus of City Council to not have Item UP-16-08 come back for a <br /> <br />second reading at the September 27, 2016 City Council meeting. <br /> <br />(b) UP-16-09 UPTOWN - Benjamin Washington, of Homebuilders Inc, is <br />requesting a use permit to build a three-unit townhouse at 601 <br />Jamestown Avenue. The Comprehensive Plan’s Generalized <br />Future Land Use Map recommends mixed use development on the <br />parcel. The parcel is approximately 0.13 acres.
