August 23, 2016 <br /> <br /> pursuant to Virginia Code subsections 2.2-3711 A.6 and A.29 for the purpose of <br />discussing the award of a public contract involving the expenditure of public funds and <br />the investment of public funds where competition or bargaining is involved, where <br />discussion in an open session would adversely affect the bargaining position or <br />negotiating strategy of the City and the financial interest of the City, specifically <br />regarding existing and potential future contractual relationships with the Southeastern <br />Public Service Authority for post-2018 waste disposal services and the construction of a <br />transfer station; and <br /> <br /> pursuant to Virginia Code subsection 2.2-3711 A.1 for the purpose of discussing <br />and considering the performance of appointees to boards and commissions, specifically <br />regarding the Board of Commissioners of the Portsmouth Redevelopment and Housing <br />Authority. <br /> <br /> pursuant to Virginia Code subsection 2.2-3711 A.1 for the purpose of discussing <br />and considering the performance of appointees to boards and commissions, specifically <br />regarding a member of the Board of Commissioners of the Portsmouth <br />Redevelopment and Housing Authority; <br /> <br />pursuant to Virginia Code subsection 2.2-3711 A.1 for the purpose of discussing <br />and considering the performance of appointees, specifically council appointees. <br /> <br />In addition, I move to go into closed meeting pursuant to Virginia Code <br />subsection 2.2-3711 A.7 for the purpose of consultation with legal counsel pertaining to <br />actual or probable litigation, where such consultation in open meeting would adversely <br />affect the negotiating or litigating posture of the City, specifically regarding Estate of <br />William Chapman, filed in Portsmouth Circuit Court; and <br /> <br /> pursuant to Virginia Code subsection 2.2-3711 A.7 for the purpose of consulting <br />with legal counsel employed by the City regarding specific matters requiring the <br />provision of legal advice by such counsel, specifically regarding potential claims and <br />civil liability related to Virginia Retirement System payments or non-payments. <br /> <br /> By a majority voice vote the following items were excluded from being discussed <br />as part of the closed session: <br /> <br />Ayes: Cherry, Edmonds, Whitaker, Wright <br />Nays: Moody, Psimas <br /> <br />pursuant to Virginia Code subsection 2.2-3711 A.1 for the purpose of discussing <br />and considering the performance of appointees to boards and commissions, specifically <br />regarding the Board of Commissioners of the Portsmouth Redevelopment and Housing <br />Authority. <br /> <br /> pursuant to Virginia Code subsection 2.2-3711 A.1 for the purpose of <br />discussing and considering the performance of appointees to boards and commissions, <br />specifically regarding a member of the Board of Commissioners of the Portsmouth <br />Redevelopment and Housing Authority; <br /> <br />pursuant to Virginia Code subsection 2.2-3711 A.1 for the purpose of discussing <br />and considering the performance of appointees, specifically council appointees. <br /> <br />The final motion was adopted by the following vote: <br /> <br />Ayes: Cherry, Edmonds, Whitaker, Wright <br />Nays: Moody, Psimas <br /> <br />Motion by Dr. Edmonds, and seconded by Mr. Cherry, pursuant to Virginia Code <br />Section 2.2-3712(D) certifying that, to the best of the Council Members’ knowledge: <br /> <br />1.
