February 23, 2016 <br /> <br />Background: <br /> <br /> Virginia law requires localities to operate, or contract for the operation of, a public <br />animal shelter (more commonly known as a pound). <br /> <br /> Chapter 4 of the City Code specifically states that Portsmouth Humane Society, <br />Inc. will provide certain required public animal shelter services. <br /> <br />Discussion: <br /> <br /> <br /> Although the City has a longstanding relationship with the Portsmouth Humane <br />Society, PHS is a private non-profit and is not a City department or governmental <br />affiliate, nor does it employ City staff. <br /> <br /> The proposed amendments modify the City Code to provide that the services <br />required under Virginia law may be provided by the Portsmouth Humane Society or any <br />other public animal shelter. <br /> <br />Financial impact: <br /> <br /> The City is required by Virginia law to provide or contract for public animal shelter <br />services. <br /> <br />Recommended Action: <br /> <br /> Adoption of the resolution. Vision Principle: Efficient, Responsive Government. <br /> <br />Next Steps Following Council Action: <br /> <br /> The amendments will be incorporated into the City Code. <br /> <br />Motion by Mr. Meeks, and seconded by Ms. Psimas, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE TO AMEND CHAPTER 4 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTIONS 4-9, 4-13, 4-32, 4-97, <br />AND 4-98 PERTAINING TO PUBLIC ANIMAL SHELTERS AND BY ADJUSTING <br />CITATIONS TO THE CODE OF VIRGINIA TO REFLECT AMENDMENTS TO STATE <br />LAW.” <br /> <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright <br />Nays: None <br /> <br />16 - 61 - Adoption of a resolution authorizing the City Manager to execute such <br />instruments as are necessary or desirable to vacate, release, convey and/or <br />quitclaim easements or other property interests of the City in the properties <br />currently operated by Portsmouth Redevelopment and Housing Authority as <br />Lincoln Park and Dale Homes and further authorizing the creation by PRHA of <br />any entities necessary or desirable to leverage financing vehicles for the <br />redevelopment of Lincoln Park and the rehabilitation of Dale Homes. <br />Vision <br />. <br />Principle: Neighborhoods and a Sense of Community <br /> <br />Background: <br /> <br /> The Portsmouth Redevelopment and Housing Authority (PRHA) is undertaking <br />the demolition and redevelopment of the Lincoln Park public housing community and <br />the substantial rehabilitation of the Dale Homes public housing community. <br /> <br /> The redevelopment and rehabilitation will benefit Portsmouth by significantly <br />improving the quality and condition of the City’s affordable housing. <br /> <br />Discussion: <br /> <br /> <br /> Because the redevelopment and rehabilitation will take place entirely on the <br />current sites of Lincoln Park and Dale Homes, it may be necessary to reconfigure <br />existing utilities and/or vacate, release or convey existing City easements. There is no <br />risk to the City from releasing existing easements because any new easements which <br />are necessary will be granted by PRHA during the site plan review and approval <br /> <br />process. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
