February 23, 2016 -Discussing the award of a public contract involving the expenditure of public funds and the investment of public funds where competition or bargaining is involved, where discussion in an open session would adversely affect the bargaining position or negotiating strategy of the City and the financial interest of the City, specifically regarding existing and potential future contractual relationships with the Southeastern Public Service Authority for waste disposal services; and -pursuant to Virginia Code subsections 2.2-3711 A.7 and A.15 for the purposes of consulting with legal counsel employed by the City as to a legal matter requiring the provision of legal advice by such counsel, and discussing or considering medical records excluded from the Virginia Freedom of Information Act pursuant to subdivision 1 of Virginia Code section 2.2-3705.5, specifically regarding advanced sick leave; and -pursuant to Virginia Code subsection 2.2-3711 A.6 for the purpose of discussing the investment of public funds where competition or bargaining is involved, specifically regarding contracting for MWBE policy development services; and -pursuant to Virginia Code subsection 2.2-3711 A.1 for the purpose of discussing prospective candidates for and appointees to boards and commissions; and -pursuant to Virginia Code subsection 2.2-3711 A.7 for the purpose of consultation with legal counsel pertaining to actual or probable litigation, where such consultation in open meeting would adversely affect the negotiating or litigating posture of the City, specifically regarding City of Portsmouth, Virginia v. South Norfolk Jordan Bridge, LLC, Portsmouth Circuit Court case numbers CL 15002064-00 and 01; and -pursuant to Virginia Code subsection 2.2-3711 A.1 for the purpose of discussing the performance of a member of City Council. The motion was adopted by the following vote: Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Wright Nays: Whitaker Motion by Mr. Cherry, and seconded by Dr. Edmonds, pursuant to Section 2.2- 3712(D) of the Code of Virginia, certifying that to the best of the Council Members’ knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion, by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council.
