<br />At a Regular Meeting of the City Council on Tuesday, September 8, 2015, there
<br />were present:
<br />
<br />Mayor Kenneth I. Wright, *Vice Mayor Elizabeth M. Psimas, William E. Moody, Jr.,
<br />Paige D. Cherry, Dr. Curtis E. Edmonds, Sr., Dr. Mark M. Whitaker, City Manager Dr. L.
<br />Pettis Patton, Interim City Attorney Cheran D. Cordell.
<br />
<br />Councilman Curtis E. Edmonds, Sr., opened the meeting with prayer, which was
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br /> Mayor Wright called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Dr. Edmonds, and seconded by Dr. Whitaker, to approve the minutes
<br />of a Called Meeting of August 25, 2015, and of a Regular Meeting of August 25, 2015,
<br />and was adopted by the following vote:
<br />
<br />Ayes: Cherry, Edmonds, Moody, Psimas, Whitaker, Wright
<br />Nays: None

<br />- Public Hearing -
<br />
<br />
<br />15 - 322 - Public hearing on use permit application:
<br />
<br />UP-15-09 PORT NORFOLK - Stephen R. Romine, Esq. of the law firm LeClair Ryan,
<br />on behalf of SEJ Asset Management and Investment Company, requests
<br />a Use Permit to expand the existing fuel operations facility for a 7-11 at
<br />700 Mount Vernon Avenue. The property is zoned General Mixed Use,
<br />GMU, and is designated as part of a mixed use corridor on the
<br />Comprehensive Plan Future Land Use Map. Vision Principle: A Robust
<br />Economy for Working Men and Women.

<br />1. Jean Mumm, 999 Waterside Drive, Norfolk, spoke in support of this item.
<br />
<br />Motion by Ms. Psimas, and seconded by Mr. Moody, to concur with the
<br />recommendation of the Planning Commission that UP-15-09 be approved on first
<br />reading, and was adopted by the following vote:

<br />15 - 307 - Use permit:
<br />
<br /> Motion by Ms. Psimas, and seconded by Mr. Moody, to adopt the following
<br />resolution approved on first reading at the August 25, 2015 meeting, and was adopted
<br />by the following vote:
<br />
<br />15-307:
<br />
<br />“RESOLUTION ADOPTING A REVISED FLOODPLAIN MANAGEMENT PLAN FOR
<br />THE CITY OF PORTSMOUTH, VIRGINIA.
<br />
<br /> WHEREAS,
<br />in order to remain a participating member of the National Flood
<br />Insurance Program’s Community Rating System Program, a floodplain management
<br />plan must be adopted by the governing body of the participating member locality and
<br />updated every five years; and
<br />
<br />WHEREAS,
<br /> the City’s Comprehensive Plan also identifies the need to “continue
<br />to participate in the National Flood Insurance Program, enforce the Floodplain
<br />Ordinance, and pursue policies to minimize the risks of flood damages”; and
<br />
<br />WHEREAS,
<br /> the City Council originally adopted a Floodplain Management Plan
<br />on September 13, 2005, and
