That the amended use permit is approved subject to the following <br />conditions which shall be observed by the applicant and any successor in interest: <br /> <br />(a) The occupant load of the facility shall not exceed 100 children at any time as <br />required by the Building Official. <br /> <br />(b) The hours of operation shall be no earlier than 5:30 a.m. to no later than 11:30 <br />p.m. The outdoor playground shall be limited to use only between the hours of 8:00 <br />a.m. and 6:00 p.m. <br /> <br />(c) Prior to the issuance of any building permits a complete set of building plans and <br />specifications for all improvements shall be submitted and approved by the City, and in <br />particular: <br /> <br />(1) All interior improvements and the playground area shall comply with all <br />requirements determined to be applicable by the Building Official and the Fire <br />Marshall’s Office. <br />(2) The loading and unloading spaces on High Street and King Street shall <br />specifically be approved by the City Engineer and Planning Director and all related <br />required signage shall be installed at the expense of the applicant. The Planning <br />Director shall also approve the playground area and any other modifications to the site <br />layout required by the Child Day Care Center. <br />(3) The applicant shall obtain approval from the Downtown Design Committee (DDC) <br />for any exterior alterations, including signage and the playground area. <br />(4) Applicant shall provide street frontage parking lot landscaping along King Street <br />in accordance with the requirements of all applicable City Ordinances. <br /> <br />(d) The applicant must obtain and keep current any required operating licenses and <br />shall operate in accordance with federal, state and local regulations. <br /> <br />(e) All taxes/fees associate with the property and/or the use shall be paid when due. <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the above conditions may <br /> <br />serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br />15 - 308 - Adoption of an ordinance to appropriate the sum of $560,000 in the <br />Administration, Attendance & Health classification of the FY 2015-16 Portsmouth <br />Public Schools General Fund, the sum of $216,526 in the Operation and <br />Maintenance classification of the FY 2015-16 Portsmouth Public Schools General <br />Fund, and the sum of $12,223 in the 2015-16 Portsmouth Public Schools Textbook <br />Fund, with all of the said sums being appropriated to fund the first quarter of FY <br />2015-16. : <br />Vision Principles Quality of Life and Lifelong Learning Community. <br /> <br />Background: <br /> <br /> As part of the Fiscal Year 2015 – 2016, City Council adopted an ordinance to <br />appropriate funding by category to the Portsmouth Public School System. <br /> <br /> All new funding requires an appropriation by City Council. <br /> <br /> This ordinance required that if the Portsmouth School Board need to move funds <br />across categories, then the board must request approval from City Council before doing <br />so. <br /> <br /> <br /> <br /> <br /> <br /> <br />
