<br />3. That the use permit is approved subject to the following conditions which
<br />shall be observed by the applicant and any successor in interest:

<br />(a) The development shall be in substantial compliance with the plan entitled Taco
<br />Bell – Portsmouth, VA Use Permit Application prepared by Curry Engineering dated
<br />February 2015 and the rendered elevations entitled Taco Bell, 1267 Frederick
<br />Boulevard, Portsmouth, VA prepared by Mark D. McCluggage, AIA, CCS dated October
<br />2014, except where modifications may be required to comply with the requirements of
<br />the City Code.
<br />
<br />(b) Landscaping improvements on the site shall be consistent in design and
<br />materials with those in the approved plans for the Frederick Boulevard Streetscape
<br />Demonstration Project.
<br />
<br />(c) The facility shall be operated in compliance with applicable codes, ordinances
<br />and regulations of federal, state and local government, and all required licenses and
<br />permits shall be obtained and remain in effect during the operation of the facility.
<br />
<br />(d) All taxes/fees associate with the property and/or the development shall be paid
<br />when due.

<br />REVOCATION OF PERMIT:
<br />4. Violation of any of the above conditions may
<br />
<br />serve as grounds for revocation of the use permit by City Council.”

<br />Background:
<br />
<br /> As part of the Fiscal Year 2014 – 2015 Budget, City Council adopted an
<br />ordinance to appropriate funding by category to the Portsmouth Public School System.
<br />
<br /> This ordinance required that if the Portsmouth School Board needed to move
<br />funds across categories, then the board must request approval from City Council before
<br />doing so.
<br />
<br />Discussion:
<br />
<br /> After a recent review of the expenditures for Fiscal Year 2014 – 2015, the
<br />Portsmouth School Board determined that there was a need to adjust the funding levels
<br />in some of the categories in order to meet projected costs for the remainder of the year.
<br />
<br /> On May 7, 2015, the Portsmouth School Board adopted a resolution requesting
<br />that City Council realign its categorical funding to reflect the following:
