March 3, 2015 <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the zoning district(s) of surrounding lands; <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in the zoning districts; and <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br /> 2. That Operation Restore Dreams is hereby granted a use permit pursuant <br />to Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to operate <br />a child day care center at 450 Dinwiddie Street, and being more particularly described <br />as: <br /> <br />UP-15-01 <br /> <br />450 Dinwiddie Street <br />(Tax Parcel 0012-0930) <br /> <br />BEGINNING at the southwest corner of Queen Street and Dinwiddie Street; thence in a <br />westerly direction approximately 245’ to a point; thence in a southerly direction <br />approximately 110’; thence in an easterly direction approximately 234’ to the western <br />line of Dinwiddie Street; thence in a northerly direction approximately 110’ along the <br />western line of Dinwiddie Street to the point of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The days and hours of operation for the child day care activities shall be Monday <br />through Friday and operated no earlier than 5:00 a.m. and no later than 8:30 p.m. <br /> <br />(b) The applicant shall receive a written determination of compliance from the City’s <br />Building Official that confirms that the necessary building alterations and/or <br />modifications are permitted, approved and completed prior to the initiation of the use. <br />The City’s Building Official has interpreted that the proposed use represents a change <br />of occupancy to an I-4 child care facility, as defined by the 2012 Virginia Construction <br />Code (Part I of the Virginia Uniform Statewide Building Code – Effective July 14, 2014). <br /> <br />(c) The child day care center shall be limited to an occupancy of twenty (20) children <br />based upon the requirements outlined in Portsmouth City Code Section 40.1- <br />4.3(B)(1)(a)(iv), which requires that drop off/pick up spaces for children are configured <br />so that a child will not cross a vehicular travelway. The existing curbside loading zone <br />provides space for two (2) vehicles. <br /> <br />(d) The child day care center shall provide eight (8) off-street parking spaces, as <br />required by Portsmouth City Code Section 40.1-5.1(E), within the church parking lot <br />fronting Queen Street. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
