December 9, 2014 <br />(b) Z -14 -04 VICTORY CROSSING /NEW PORT - Request of Thomas C. Kleine, <br />with Troutman Sanders LLP, to rezone approximately 30.49 acres <br />from Urban Residential — High with conditions (URH -K) to General <br />Mixed Use with conditions (GMU -K) located northeast of the <br />intersection of McLean Street and Interstate 264. The purpose of <br />this request is to allow for the commercial use of a portion of the <br />property for a Wal -Mart Grocery Store. The property is designated <br />in a Mixed Use Corridor on the Future Land Use Map in the City's <br />Comprehensive Plan. Vision Principle. A Robust Economy for <br />Working Men and Women. <br />(c) UP -14 -13 VICTORY CROSSING /NEW PORT - Request of Thomas C. Kleine, <br />with Troutman Sanders LLP, for a use permit for a Drive - Through <br />window for a Pharmacy associated with a Wal -Mart Grocery Store <br />to be located northeast of the intersection of McLean Street and <br />Interstate 264. The property is designated in a Mixed Use Corridor <br />on the Future Land Use Map in the City's Comprehensive Plan. <br />Vision Principle: A Robust Economy for Working Men and Women. <br />(d) S -14 -03 VICTORY CROSSING /NEW PORT - Ordinance granting the <br />request of Thomas C. Kleine, with Troutman Sanders LLP, to close <br />a right -of -way containing 0.13 acres located north of McLean Street <br />and west of Interstate 264 that was retained when the interior <br />streets in Fairwood Homes were closed on May 10, 2005. The <br />purpose in closing this right -of -way is to allow for the development <br />of a Wal -Mart Grocery Store. Vision Principle. A Robust Economy <br />for Working Men and Women. <br />Motion by Mr. Moody, and seconded by Mr. Meeks, to withdraw Items 14- 441(b), <br />14- 441(c), and 14- 441(d) by request of the applicant, and was adopted by the following <br />vote: <br />Ayes: Cherry, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />- Unfinished Business - <br />14 - 441 - Use permit: <br />14 -441 (a): <br />Motion by Mr. Moody, and seconded by Mr. Meeks, to adopt the following <br />resolution, and was adopted by the following vote: <br />"RESOLUTION GRANTING A USE PERMIT (UP- 14 -15) TO VERDAD REAL ESTATE, <br />INC., TO CONSTRUCT A 7- ELEVEN CONVENIENCE STORE WITH GASOLINE <br />SALES AT THE NORTHEAST CORNER OF THE INTERSECTION OF EFFINGHAM <br />STREET AND LINCOLN STREET, ALSO REFERENCED AS 1811 EFFINGHAM <br />STREET. <br />WHEREAS, Verdad Real Estate, Inc., as contract purchaser of the subject <br />property, has made application pursuant to Section 40.1- 2.3(B) of the Code of the City <br />of Portsmouth, Virginia (2006) for the granting of a use permit to construct a 7- Eleven <br />convenience store with gasoline sales at the northeast corner of the intersection of <br />Effingham Street and Lincoln Street, also referenced as 1811 Effingham Street, <br />Portsmouth, Virginia; and <br />WHEREAS, Economic Development Authority of the City of Portsmouth, Virginia, <br />the owner of the property, has consented to the filing of the application; and <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br />
