November 25, 2014 <br />"ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTIONS 22-561(b) AND 22-575 <br />THEREOF PERTAINING TO BACK-IN PARKING IN DESIGNATED AREAS." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />14 - 446 -Adoption of a resolution authorizing the City Manager to execute a <br />Lease Agreement with Biltmore Baptist Church for use of the athletic field at 3120 <br />Elliott Avenue. Vision Principle: Neighborhoods and a Sense of Community. <br />Background: <br />• The City owns this 3.97-acre parcel, and has leased it to Biltmore Baptist Church <br />for development as an athletic field and use by Portsmouth Christian School since 1993. <br />The School is an affiliate entity of the Biltmore Baptist Church. <br />• The $1.00 per year lease expired on March 31, 2013. The Church and School <br />have maintained the field and made capital improvements to it, including field lights, <br />scoreboard and irrigation system. <br />• In the summer of 2013, City Council considered in its Work Session the options <br />for disposition of the property, including renewing the lease. City Council directed staff <br />to seek input from the Highland-Biltmore Civic League about public access to this City <br />property and the neighborhood impacts of its use by the School. The Civic League <br />voted to support the continuation of the lease arrangement with the Church. <br />• At its October 7, 2013 Work Session, the consensus of City Council was to <br />proceed with drafting a new lease for consideration by the Church and the City. <br />Discussion: <br />• Staff and the City Attorney worked to draft a new Lease Agreement and sent it to <br />the Church for consideration in October 2013. <br />• The Church executed the Lease Agreement and returned it to the City in October <br />2014. <br />Financial Impact: <br />• There is no direct financial impact. <br />Recommended Action: <br />• Adoption of the ordinance. Vision Principle: Neighborhoods and a Sense of <br />Community. <br />Next Steps Following Council Action: <br />• If approved, the City Manager will execute the Lease. <br />Motion by Mr. Edmonds, and seconded by Mr. Meeks, to adopt the following <br />resolution, and was adopted by the following vote: <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE <br />AGREEMENT WITH BILTMORE BAPTIST CHURCH FOR USE OF THE ATHLETIC <br />FIELD AT 3120 ELLIOTT AVENUE. <br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager be, and hereby is, authorized to execute such lease agreement, a copy of <br />which is attached hereto and identified as Exhibit A, and such other documents as may <br />be necessary to lease to Biltmore Baptist Church for recreational purposes that certain <br />parcel located at 3120." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />14 - 447 -Adoption of a resolution authorizing the City Manager to execute a <br />Railroad Agreement between the Commonwealth of Virginia, the City of <br />Portsmouth, and the NorFolk and Portsmouth Belt Line Railroad Company for the <br />Turnpike Road Widening Project. Vision Principle: Efficient, Responsive <br />Government. <br />
