November 25, 2014 "ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTIONS 22-561(b) AND 22-575 THEREOF PERTAINING TO BACK-IN PARKING IN DESIGNATED AREAS." Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright Nays: None 14 - 446 -Adoption of a resolution authorizing the City Manager to execute a Lease Agreement with Biltmore Baptist Church for use of the athletic field at 3120 Elliott Avenue. Vision Principle: Neighborhoods and a Sense of Community. Background: • The City owns this 3.97-acre parcel, and has leased it to Biltmore Baptist Church for development as an athletic field and use by Portsmouth Christian School since 1993. The School is an affiliate entity of the Biltmore Baptist Church. • The $1.00 per year lease expired on March 31, 2013. The Church and School have maintained the field and made capital improvements to it, including field lights, scoreboard and irrigation system. • In the summer of 2013, City Council considered in its Work Session the options for disposition of the property, including renewing the lease. City Council directed staff to seek input from the Highland-Biltmore Civic League about public access to this City property and the neighborhood impacts of its use by the School. The Civic League voted to support the continuation of the lease arrangement with the Church. • At its October 7, 2013 Work Session, the consensus of City Council was to proceed with drafting a new lease for consideration by the Church and the City. Discussion: • Staff and the City Attorney worked to draft a new Lease Agreement and sent it to the Church for consideration in October 2013. • The Church executed the Lease Agreement and returned it to the City in October 2014. Financial Impact: • There is no direct financial impact. Recommended Action: • Adoption of the ordinance. Vision Principle: Neighborhoods and a Sense of Community. Next Steps Following Council Action: • If approved, the City Manager will execute the Lease. Motion by Mr. Edmonds, and seconded by Mr. Meeks, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT WITH BILTMORE BAPTIST CHURCH FOR USE OF THE ATHLETIC FIELD AT 3120 ELLIOTT AVENUE. BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and hereby is, authorized to execute such lease agreement, a copy of which is attached hereto and identified as Exhibit A, and such other documents as may be necessary to lease to Biltmore Baptist Church for recreational purposes that certain parcel located at 3120." Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright Nays: None 14 - 447 -Adoption of a resolution authorizing the City Manager to execute a Railroad Agreement between the Commonwealth of Virginia, the City of Portsmouth, and the NorFolk and Portsmouth Belt Line Railroad Company for the Turnpike Road Widening Project.
